1-751(Notice of intent to deny)
My application was submitted Nov-12-2019,I got rfe,case was transferred to field office for interview and I went for interview April 2021 and everything went so smooth that day but I was told am gonna recieve the decision letter.
Lastweek,I got the letter stating the notice of intent to deny (NOID)asking for more proof of my divorce letter(customary Court)because it can’t be confirmed and the same divorce letter I use for my conditional 2yrs greencard..
Advise is needed Pls...

That decree being from a customary court especially if it came from Africa will be next to impossible for them to confirm.

Bro you need to contact a military recruiter and join the military ASAP so they can switch you from marriage based to military based. Because they will hold on to that divorce decree to keep denying you even if you reapply

try to contact your family in Africa to get an updated court letter or a letter explaining your situation. you can also write a letter as well. once your I-751 is denied, you won’t be able to appeal unless you think they wrongfully denied your application.

USCIS is convinced that every divorce decree especially from Nigeria is fake. Getting a letter from Africa and all won’t do you much good. But no harm in trying

Registry marriages, regardless of whether they are federal or local registry, can only be dissolved through a High Court. Post often sees divorce certificates issued by lower (customary and magistrate) courts purporting to have dissolved a registry marriage; these divorce orders are not legally binding. There is a strict divorce procedure for marriage contracted under the Marriage Act, as set out in the Matrimonial Causes Act of 1970. One requires the services of an attorney to file a divorce petition and follow through with the legal processes in Court. After filing the necessary papers in Court, there is a trial. At the end of the trial, the Court may grant or refuse the Divorce. Where the divorce is granted, the order is temporary and is called a Decree Nisi. There is a three month period allowed in the event of reconciliation between the couple. At the end of the three months, if the parties have not reconciled, then the divorce decree will automatically become absolute and a Decree Absolute is issued. At this point, the legal bonds of marriage are permanently severed unless the couple remarries. However, it is important to know that both parties are free to marry other parties once the Decree Nisi is issued; they need not wait for the Decree Absolute. [Note: As stated above, many couples perform more than one type of marriage ceremony. For divorce proceedings, once a couple has completed a Registry Marriage, the only legal method of divorce is through the High Court process. The High Court process is also the only legal method of divorce for residents of Nigeria who married outside of Nigeria.

James tee, did you have a registry marriage? Customary court marriage or divorce is not acceptable for documentation purposes in the US. If you check the documentation acceptable from Nigeria citizens, divorce should only be issued from High Court- Decree Nissi and absolute.
It is allowed to take your customary court divorce certificate to high court to get the needed, if your marriage was in a customary court. Customary marriages do not even need a divorce.(CUSTOMARY MARRIAGES: There is no legal requirement that a customary marriage should be dissolved by any court, nor any requirement that the divorce be registered or documented -Source:US travel state website).
But if you had a registry wedding, the divorce should be initiated at High court.

please go to your country's embassy for validation of the said divorce letter. marriages are annulled under the customary legal system. you can also send it to the ministry of foreign affairs of your country for revalidation which is also acceptable in United States. thanks and Good luck.

JF k, please read and understand instructions on the US state travel website before giving any advise. Every country has their unique acceptable documents, agreed upon with the US department of state, due to their diplomatic relationship. Do not misinform people in what you are not sure of and be reminded that any misrepresented document not in compliance with a country's procedure will be deemed fraud.

@ Gucci G, I have finally found the link, please always try and get the true position of any document so enacted. I guess you created panic by asserting a rule that wasn't factual within the contest of United States Travel agency body, however, the document is open for public consumption.
One fundamental thing you have to understand is that every law so enacted leaves a vacuum, and such lacuna creates and exception to such law(s). Customary marriage was not abrogated under the said traveling document, any person person should go and google "Visa reciprocity and civil documents" and then click on his country of choice. thanks.
