I think filing a new I-485 would’ve been your best bet

ny removal was terminated on June 2022. since then, I hope written, call, and uploaded the Judge order on my online account nothing has happned yet. please keep me posted if any update thank you.

@Abdou. it will be better for you to just file a new I-485. That will be quicker

Eva jo don't waste your money on new application that's what my lawyer did in my case it's been 9 months now since she file it stuck on actively reviewed while my first i485 now at my fo I had 4 inquiries myself the last inquiry they reply say within 60 days I should get a decision are a notice from them

my lawyer didn't close my first case she just told me whichever one they get to first it's ok to have more than one application on file

start calling them since I start calling them myself I got my ead in june and my case got move to the fo and this is my old case

Anyone here submitted joint motion to dismiss to the BIA ?

David yes it wasn't hard for me I had really good evidence my lawyer send everything she could I had an final removal in 2008 which I didn't know about my joint motion was dismiss now am back with uscis

I also have approved i130 at the same time

@tas smith So you saying you sent a joint motion to the Board of immigration appeals(BIA) and not your local immigratin court right ? just to confirm lol . I applied for prosecutorial discretion to DHS , and got it last month based on my approved petition . I filed the joint motion last week and sent to BIA. if was the BIA how long did it take ? Please and thank you !

David last year I also did i485 with the court my lawyer didn't want to do it with uscis cause she wasn't sure how long it will take so when my case got dismissed my case got send to uscis now it's at the fo am just waiting for a decision

David if uscis pick up your case before BIA they just gonna administratively close it you can reopen again

@M M I filed in Baltimore court. It took a little over a month

@eva were the same case, i filed around 2019 then admin closed i485 my lawyer filed a motion so I don’t have hearing. on 2021 my i130 is actively reviewed by USCIS until now i haven’t heard it yet. ( I don’t have an interview at all)

@j a are you serious I first in 2019 when I hear I have removal my i130 was approved in the end of 2019 my lawyer went to the court got dismissed in 2021 now just waiting on uscis what is your lawyer doing

Hello whoever read this. i have removal proceeding too here is my timeline. october 2019 i filed i485 and i130 december 2020 my i485 form administrative closed January 2021 my i130 is actively review by USCIS September 2021 the judge approved motion since then my case still like that. I don’t have any interview or whatsoever. please any advices? is this how it works ? is my lawyer did the right thing? MINNESOTA court

@j a actually my lawyer did alot first get my case reopen then change venue cause my removal was in a different state and get dismissed where I live now I didn't have to go to court

@ ja you need to make an inquiry about your i130 it should have been approved so you can ask the judge to terminate your case

@ja yes your lawyer did you wrong they should have filed i130 and get that approved then take it to the court and ask for your case to be terminated then file everything with uscis if you get dismissed anyway it's not to late now you going to have to keep bothering uscis until they approve your i130 without it your stuck called them send inquiry

@tas can i call USCIS even without my lawyer permission? my motion indicate that i can continue process my papers

@ja yes you can call the 1800 and ask for info pass then go online and make an inquiry under your i130 you can call as many times as you want

@ja ask your lawyer to change venue from Minnesota to ND the court won't have any problem doing that overall ja please look into getting another lawyer that lawyer is no good for you
