AOS in US with pending Asylum
Dear Members
is anyone get approval of I-485 AOS in usa on employment based EB-3 with panding Asylum ( Asylum petition filed before I-94 expiration)

I went through same process and the case officer from field office denied the case without any interview, no RFE & no NOID. Direct denied. Reason of denial "Pending asylum is not Lawful status". My I-94 was expired when i applied for asylum. I was allowed for 2 weeks in USA by CBP. Officer didn't mention too much about I-94 expiry but main focus was on Pending asylum status. So now i am going to apply for consular process with advance parole that i got from pending asylum. Will inform NVC for third country consulate interview.
