Apex IT System Case: USCIS denied the case even after hiring a lawyer and providing justification/clarification regarding the relationship with the blacklisted employer.
If you were associated with Apex IT System, please avoid travel and do not mention Apex in any correspondence with USCIS. If they inquire about Apex in your history and why it wasn’t included in your visa application/petition, explain that you learned Apex was fraudulent and did not actually work for them. Therefore, including them in your past professional experiences is not appropriate.
I received one RFE and two NOIDs. Ultimately, my employer and I decided to withdraw the case to avoid a denial, as USCIS’s intention in the NOID was to declare me inadmissible if the case was denied. Currently, my H1B petition is withdrawn, and I have moved back to India.
