AOS vs IVP
I got I-140 approved in EB2-NIW with PD Nov 2023. I am from ROW country and my PD is not current. My current visa is expiring soon. By the time my EAD expires the PD is not likely to be current for filing either. So I am planning to go for IVP. Has anyone in this group gone for IVP instead of adjustment of status? If so, what are the risks involved as opposed to doing adjustment of status?

@R P AOS is easier than consular processing due to uscis may waive your interview. if you file I-485 you can get ead and AP. Doing AOS is much beneficial than COS. it doesn't mean they will not give you a gc if you apply from abroad.

@N F I485 is not a option for him, he has to go through consular processing.

if you change your visa to F-1 status and start studying till you can file I-485, it would be better and safer than do it through consular

@R P Consular processing is totally unpredictable, you always want to maintain status and then adjust.

it depends on the waiting line in ur country, in brazil for example the backlog is huge. consular processing final action date is nov/22 now. u are not even current to be in the line for the interview for ivp.
