birth certificate issue for filling I 485 form for spouse under employment category (dependent on primary )
My spouse has got RFE from USCIS due to missing birth certificate from india after filling her I 485. Though she submitted a certificate she received from Indian embassy in the US, USCIS didn’t accept that letter. Now she got an affidavit (notarized) in india and also got a letter from local municipal corporation certifying her birth details based on affidavit as she was born at home and not any hospital or nursing home . Can she submit the municipal corp. provided letter (certifying her birth date) along with the notarized affidavit (from her mother) from India to USCIS in response to the RFE? Does she need additional affidavit from her uncle to make her case more genuine to USCIS ? will USCIS accept these documents? Pls suggest

yes. she got a notarized affidavit from her mother and local municipal authority also issued a letter based on affidavit. but not sure if USCIS will accept these docs

@yog Sham , that’s pretty legit doc to send an affidavit with birth details and duly signed, USCIS will certainly accept that. My Indian birth certificate was in Hindi and all torn up, i submitted it with english translation , and USCIS has no problem with that. Good luck and keep us posted about your journey . warmly

they do not accept the birth certification based on her passport from the embassy/consulate. you need to have the certification done at the municipality where your spouse was born and make sure they do not say “according to her passport” in the certification; have them write …”according to our records…”

USCIS goes by standards established by the US state department reciprocity schedule. Please look at https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/India.html for guidance on acceptable documents in lieu of a birth certificate, non-availability, etc. You should include notarized affidavits from parents (include proof of relationship), and similar from the local/regional (?) registry of births/deaths, sealed, signed, notarized, in addition to education board cert that may corroborate DoB. More the better. G’luck!

I have a similar query. my birth certificate was issued by Gram Panchayat Secretary in Hindi language and I got it translated into English language through a Notary. I submitted the translated certificate along with Matriculation certificate at the time of K1 VISA interview in Mumbai also. Recently I received RFE for birth certificate in respect of my pending I-485 application. I have same documents as proof of birth certificate which I had already submitted with I-485 application back in September 2021. what should I do now? please help.

I have seen few visa support agents do recommend for birth certificate issued by gram panchayat or Taluka from India. But not sure if USCIS officer will accept it for I - 485 application processing
