I sent the medical exam a week ago and received the same today. My case EB 3 skilled. I wonder how long the visa number will be available 🙄🫣

Eb2 was recently retrogresses, maybe that’s why?

@snfj roro yes that is the reason. but this status was not shown on all the applicant whose case were retrograde.

yeah as soon as they get the number, it’ll be approved. I also heard that some people still get approved even with retrogress because the FO their application is at has some visa numbers left over because apparently FO has certain number of visas assigned

mine is the same, it was updated this month, I have seen people on the same situation in the past and the next steps for us will be (new card has been produced) however we need to wait for the visa bulletin become current again, my PD is 12/20. I think when it is updated to that our case was interviewed waived because all that I saw in the past who was interviewed was updated to (interview schedule) that’s why I am so confident, our next update will be good news.

another thing that keep me so confident is, if your I-485 will be denied they denied it even if you aren’t current, no matter what is your PD, they won’t put (case remaining pending) also any RFE will be asked even if your PD isn’t current, that’s why (case remaing pending) is so great to us, that’s means we are already reviewed and everything is good, unfortunately they can’t give us approval because they need to have visa number available. all of this make sense right? let me know guys if you have or had seen different things thank you

@EB3-3 Unskilled (Other Worker) yes. that’s what I have seen. Otherwise they would update it now, for example an RFE, an interview or even denied. They don’t need your PD to be current to denied, to schedule an interview or ask an RFE. Is it make sense ? when you are (Case remaining pending) it is means “everything is good we are just waiting for your PD be current.

I have read the same things during my search. even wil the lawfully analysis you can see that after CRP the next step is card being produced. and one thing is for sure that this status of CRP comes when the officer review your case. if they would have found something not correct they would have rejected straight away. I hope that when the PD becomes current we also get the approval. moreover, most important not all the applicant got the CRP status even for them the PD was not current anymore. this means that they don't send this message to everyone.

@khizar abid yes for sure, if you just search a little you are gonna see a pattern on this. Tgey won’t put you in CRP if they need an interview or RFE they will request it first before put you in CRP that’s why I am so confident, now just waiting our PD to get approval

Mine is also in the same status since Feb 11.This is what I found in USCIS website, “A “Case Remains Pending” message in the USCIS Case Status Online tool indicates that an officer reviewed the application and determined that it could not be approved on that date because DOS could not allocate a visa number. Once a visa number can be allocated, USCIS will resume the processing of the application but not every action that USCIS takes on an application results in a change in the message displayed in the online case status. If the applicant has submitted a transfer of underlying basis request, USCIS will continue processing that request and moving the application forward in the adjudication process. @khizar abid that’s what I believe as per the official statment posted by USCIS in their website. I have seen people’s status chnaged to “Card being Profucded” after “Case Remains Pending” status. hopefuly, it will be dame for all of us.

there is one more thing I have applied the GC with my dependents. they also got the same message. that looks like the whole file was processed at the same time

@sat ban there might be a possibility that the visas for India are low, as you know each country has a specific quota. but I really hope that you get it soon

anyone has the list of the officers in regard to their acceptance or denials? i know there is a chart with different officer numbers detailing the ones that approve and the ones that are a little more harsh

how come the i485 approvals happening for other folks whose PD is after June 2022 (EB1 India), if there is a scarcity on visa numbers…any thoughts from others ?

@GC ASAP @EB3-3 Unskilled (Other Worker) @sat ban @tiko tiko @EB3 UNSKILLED @Anonymous S @snfj roro today I got the letter from uscis in which it was stated "a final decision cannot be made on your case at time because a visa number is currently not available. this office us transferring your pending i485 case to the location indicated below (Texas service center). this office will retain your case until the visa number becomes available and will ultimately conduct the final processing of your case. this transfer will ensure better customer service and faster processing." A part from that my family got the alien number as it was stated in the letter.

@EB2 NIW is this because you are Eb2 NIW and your priority date is whenever you submitted your I-140? when did you submit I-140? and what FO was your application at?

@snfj roro I submitted my i140 on 11th July 2022 and my PD is the same

@EB2 NIW aww man :( it’s because the final action date for EB2 shows as 01 July 2022 and yours is 11 July 2022 so just missed it by few days. hopefully it gets current soon so you get approved. I think it’s a good sign though. because think about it, if they wanted to deny, they wouldn’t pause your application I think, they would just deny it right away

@snfj roro I really hope that it gets approved. and yiu are right if there would have been any problem alien number wouldn't have been given. just have to wait a bit longer as of now the PD has been regressed to 15th feb

I am EB3 skilled worker. My PD is 07/26/21, since my labor was summited that day and my I-140 and ETA 9089 as that date as a PD… I summited my I-485 in May 2022, 2 months later I got a RFE, summited by beginning of august2022. Then my case reminded as “Correspondence was received and USCIS is reviewing it” until today that I got a new status of “cases remind pending”

Me and my family just received an update about our I-485, Case Remains Pending. PD is Sept 2022 and according visa bulleting PD is July 15th 2022 😔.
