No. the thing is that my case was not denied. I had a removal proceeding so when I went to GC interview the officer approved the i130 but said my I485 will be administratively closed and that when my proceedings is terminated I should sent the court order and they will adjust my case. so that’s what I did and they reopened my I485 since they have jurisdiction over it again.

Pieter, how do you know USCIS reopened your case? I received termination from judge last week and requested Miami field office to reopen.

They sent me a notice to inform me of reopening and my case tracker says case was reopened.

ok. my case status never changed to closed. My response was sent to Miami field office and not NBC. so not sure if this makes a difference

mine either. after my interview they sent me a notice of administrative closure but the case status online remained “interview was completed and your case must be reviewed”. I mailed my reopening request to my field office as well. they reacted and reopened my adjustment maybe 2 months after I sent the request so be patient.

Israel, I think your case is a little different, you should call them to understand.

Mmls I, I am still waiting for a response after my case has been reopened. it took little than a month for them to reopen my case. I also completed both interviews so I think they will just approve my application but we’ll see how it goes. Hopefully we hear something soon

I don’t know. I spoke to a USCIS rep who said that they might need to conduct another interview but my lawyer said it’s unlikely. unless either you did not complete your i485 interview or they are missing some paperwork. or interview was conducted a long time ago. otherwise the next step should be to approve your adjustment.

what was approved? i130 or i485? if you were on removal proceedings, they do not approve the i485 until removal is terminated. The i130 can be approved and then they close administratively your adjustment until termination. that’s why when the removal is terminated, you have to forward it to your field office and they will pick up your case from where it was left at. it better to call your field office directly to have better information about your case.

Shak, no update at the moment. I do not know their process, I just know they have 90 days to give me a response before I can inquire. they still have 25 days remaining

All we can do now is wait. I believe we can inquire 90 days after reopening date. mine should even be straight approval because my officer was kind enough to do both i130 and i485 interviews last year. I’m 2 week away from the 90 days period.. hopefully we all get out of this nightmare soon. thank you

yes you can try that, also you should have evidence to show what emergency you are in!

yes you can get an appointment, you can either call USCIS or chat with Emma and then live agent, explain them and tell them that you are terminated and have the termination letter, and you would like to have an infopass to the local field office so I can give them the letter

Kay jay, I did travel with advance parole before and will likely travel again soon.

I traveled with an administratively closed deportation order. I terminated it a while after I came back.

I would be scared if I had drug charges etc. I believe if they give you the document it’s for it to be used. I saw another post your lawyer is Renata Castro. Are you from Brazil? That’s where I traveled to.

Kay jay, I had a deportation order administratively closed. I traveled before I even applied for i130. Then I came back and applied for i130 and got it approved then went to court with 485 application and i130 approval receipt to get my removal proceedings reopened and terminated. Got that done and now need to move forward with i485 with uscis. As far as traveling, I was really scared but I had not seen my family in so long and after consulting with my lawyer and doing lots of research, I decided to go. I can’t simply tell you to go. You need to make that choice after analyzing your case and make an informed decision.

Im also Brazilian. The response from the inquiry I submitted says when I go to drop the judges letter I can also request/ask them to give me a timeline of when my case will be processed. But we all know how it goes with that.. but hopefully we’re all on the final stretch before the gc!

hi guys I dont know much about appeal case my lawyer had to appeal my case since August 24 2021 they send letter they aprove they appeal and incase they need biometric they will mail me I'm still waiting didn't hear anything yet I'm scared because they had give me 39 days to leave they country or appeal whenever i try ask my lawyer about stuff she say i have to wait she dont take my calls at times

@mmls, se tiver paciência pra falar com eles, liga. Eu liguei 3-4 vezes no mesmo dia e eles desligavam na minha cara. Até que consegui uma senhora de bom coração que de respondeu e tbm me colocou com um urgent call de um tier 2 e me ligaram de volta em 3 dias. Eu vim quando criança com minha mãe. não lembro se ela pediu asilo ou o que foi mas tínhamos corte o que ela não respondeu e daí nos deram deportação mas consegui demonstrar que não fui pq era de menor. Sobre viajar, eu tenho um amigo que nem fechou a deportação dele e já viajou 3 vezes com o advance parole.

@mmls, só mostra “case received”. Eu acho que vou acabar viajando pq já fui uma vez (AP através do DACA) e foi tranquilo

we both went for the i130 and we both going this time too. anytime you have interview for adjustment always go together, don’t even think about it.

hey guys I have a question, do I need to bring another completed affidavit form if it has been submitted already? my lawyer said that once you submit the affidavit it does not expire but you just need to bring proof of continuous support from your sponsor. last year in the interview the officer did not ask us about that, just the support from my wife
