You either wait or talk to a lawyer and sue them. As far as i know, they have 30 days to adjudicate your case after the interview then tou have the right to sue. Suing will expedite the process however, the approval is not guaranteed. I have a pending case,naturalization, and its been 7 months now with now response. I am meeting with a lawyer in 2 days to sue them. P.S. suing them is a bit costly, ranges between 4k to 5k but i am sick of waiting.

Hello Aw Sam, I am sorry to hear that. I am kinda in the same boat, Haven't heard back anything after interview. Case status still says Interview scheduled. IO said we should hear back in less than a month, But it is gonna be 2 months this week. My interview was on 29th of March @Newark NJ, Married to USC May I ask if you raised any e-request yet ? And when did you Interview? How was your interview? Do you feel there is any issue with your application? For me, My EAD renewal had wrong DOB and wrong A-Number filed on Nov 2020. I believe that is what is delaying my case. Although talked with USCIS agent and they say EAD renewal shouldn't affect gc.

Aw Sam, if you are from the Middle East you application will likely take longer than usual . A lawyer once told me America is racist, you have to deal with it. I now know what he meant. If you are within your processing time, you can’t sue. You have to wait for now until your case is unreasonably delayed. This is when a lawyer has to come and push till your case is resolved.

I would say just wait for now. Give them a bit more than 2 months maybe? Atleast that is what I am doing, Gonna place another SR on 29th. My last one got reply as pending adjudication and they don't know how long it is gonna take.

I really can’t say if this is normal or not. Your wait might extend to months. I don’t want to soud pessimistic but this is the reality. A lawyer will advise tou better than me but one thing for sure, if you are from the Middle East you will likely need to fight for your rights.

Well, My EAD expired on 29th of march as well. And Renewal form got typos. So I am focusing on getting those typos fixed to get EAD renewed sooner.

The NBC processing time says upto 10 months. So I don't really know 😓 It should take like 4 months otherwise. I called them today regarding my EAD, The lady was nice and she said she emailed the higher ups for typos to be fixes. hopefully something soon 🤞

@Aw Sam Got the same response two days back from Congressman…. I-130 PD Nov 2019 Spouse of USC It has been 18 months and still waiting for approval…. Case transferred from Texas to California in June 2020 last year…. It has been in Washington Field Office since Nov 2020 as per the update from Congressman…. Two days back in the last update from Congressman, I received the same mail as yours…. USCIS confirms that your case is under Extended Review…..

@Aw Sam I have no clue what it means…. neither does my lawyer…. i am from India… my husband in in USA so consular processing…. There is no error in documentation i think…. no criminal record…. first marriage for both of us…. nobody ever applied for this visa category before…. I don’t see no reason for any type of extended review….

Get a lawyer that knows everything, when i lawyer says “I have no clue” it means that he is still training.. I have 3 highly experienced lawyers from across states waiting for a deniel letter to come through, im Ditching my former lawyer. My case is still under extended review though.

@Aw Sam…. she is the best lawyer in town with most ratings…. Whenever we get in touch with the officers over call or message through online account, all they tell us is wait…. coz the case has been transferred to California with 28 months processing time…. so still within processing times🤦🏼‍♀️

@Aw Sam My case was transferred last year June to California and last year November to Washington Field Office…. we got these updates through Congressman and then we confirmed it with USCIS over call…. it hasn’t been updated online though…. we never received any notice…..

if its within proccessing time there is nothing else you can do except wait.. Sometimes our word is taken for granted so some have to wait until the last minute within the normal processing time, they can open an investigation under a case aka extended review for a year and later they can extended 6 months and later another 6 months and another... and so on.

Withholding adjudication. USCIS may authorize withholding adjudication of a visa petition or other application if USCIS determines that an investigation has been undertaken involving a matter relating to eligibility or the exercise of discretion, where applicable, in connection with the benefit request, and that the disclosure of information to the applicant or petitioner in connection with the adjudication of the benefit request would prejudice the ongoing investigation. If an investigation has been undertaken and has not been completed within one year of its inception, USCIS will review the matter and determine whether adjudication of the benefit request should be held in abeyance for six months or until the investigation is completed, whichever comes sooner. If, after six months of USCIS's determination, the investigation has not been completed, the matter will be reviewed again by USCIS and, if it concludes that more time is needed to complete the investigation, adjudication may be held in abeyance for up to another six months. If the investigation is not completed at the end of that time, USCIS may authorize that adjudication be held in abeyance for another six months. Thereafter, if USCIS determines it is necessary to continue to withhold adjudication pending completion of the investigation, it will review that determination every six months.

Hi - we submitted I-130 back in June 2020, no word from USCIS on approval, other than the case is under extended review. I have submitted several SRs and only 1 resulted on this above. I finally submitted an USCIS ombudsman request this week to see if I get some light on status. We will see, the question is, does someone have a template on the congressional request? I read it above and wondered how does that work. Back story: Husband is from Honduras and came to the US when he was 15 yo, had applied for asylum but was denied, then appeal denied, had EAD SS# too, never left the country, had bad counsel (ignorance due to age too) we got married 3 years ago, applied for i130 last year. Waiting game.

J CS, look up the senator or congressman representing you according to you district. Look up his official page on google search. access his/her page and look for immigration services that the senator provide. Download the required forms (usually 2 forms) fill them out and sign them. Finally, email the forms to the email provided in the form as per instructions.

J CS, yes. i waited and waited then decided to sue USCIS (writ of mandamus). I got naturalized beck in September 2021. Don’t waste time and sue them. The court will give them 60 days to respond and they will start working on your case by the end of the 60 days.

hello all I got following from congresswomen inquiry:From a current review of USCIS records, we are informed that a standard element of the background check process is pending completion in your constituent’s case. After the necessary clearance is received, the immigration file containing your constituent’s application will be referred to an administrative review. Following this review, the file may be returned to a case distribution queue for assignment to an adjudications officer. Please note we are unable to grant requests to expedite these processes. However, you may follow-up with the Nebraska Service Center (NSC) to request another case status update after approximately 90 days.
