congressional inquiry response. any insight? I’ve gotten the same response twice now.
Thank you for your inquiry regarding this constituent’s immigration matter. U.S. Citizenship and Immigration Services (USCIS) records confirm that your constituent’s case is pending at this time. USCIS is committed to adjudicating immigration benefits in a timely and efficient manner while also ensuring public safety, national security and compliance with all relevant directives. While the processing steps for most applications or petitions are completed quickly, a small percentage of cases involve unresolved issues that may result in adjudication delays. For example, if our review reveals an issue that may impact an individual’s eligibility for the requested immigration benefit, further inquiry is needed. The inquiry may include an additional interview and/or contact with another agency for updates or more comprehensive information. We are unable to determine at this time when the review process for the application will be completed. USCIS will issue a decision on your constituent's case once certain issues are resolved. We are striving to resolve these issues as soon as possible.

I had similar response as well. sort of Extended Review. I think it’s another “BS” from USCIS cuz the case is just somewhere there nobody touches whenever they want to. It’s very frustrating, I feel you. The only thing you can do service request every month until they adjudicate the case 😀

this happened to me. I got the same response. my case has been pending since August 2021. I hired a lawyer and she requested a FOIA and I found out that in 2008 I waa reported to ice and even tho they never sent me a notice to appear and the case basically never went anywhere, that is the reason I havent got my green card. I paid a lawyer 3,000 to get it resolved and showed USCIS the proof it’s closed. now I’m waiting for my decision. I don’t want to scare you but when I got that message it meant something was wrong. if you don’t have a lawyer I would get one. or if you don’t want to hire one request a FOIA asap to see what is going on ( FOIA will take 2 months to get back ) good luck

I got the same response to my congressional inquiry. After that, I got a response to my service request that I filed by myself and it said “due to workload factor not related to your case”. so as other people say that response is just BS. Meaning nothing.

Thanks for sharing. I did it on the App "Inmigra USA" the community of Immigrants in the United States. inmigrausa.com There are immigration lawyers and free collaborators. Stay up to date on news of interest to the Latino community. Search Inmigrate USA. I chose the Florida community, it looks like they are starting now, so I recommend you choose Florida. Busca inmigra USA el app del inmigrante, de verdad es muy buena tambien. Thanks!!!

@i l I did foia and requested apprehensions. nothing came back but they also couldn’t give me an answer unless I write to custom and border patrol. so might do that. was I suppose to select something else or was apprehensions the right one to pick.

@mount laurel New Jersey I’m not sure my lawyer did it for me. I know she requested my entire immigration file of absolutely everything they had on me. she also did a FBI background check and CORI. you may have something and have no idea, that was my case. best to take care of it before they pick up your case again because if there is something they will close your case

well I know it’s an awa case since they made me do my biometrics for the 130 so I’m guessing that’s part of the delay but I also know people that have gotten there 765 approved and later got and noid or rfe to get there 485 approved but are still waiting but I never even got my ead and it’s been almost two years. I could request the whole thing but I thought most of it wasn’t important. well I figured uscis was doing the fbi background check. what’s a Cori?

@mount laurel New Jersey yes I am from mass so it probably is a Massachusetts thing. in my case ghe FBI check showed things that were not on my FOIA. I also got my biometric done too. I didn’t originally apply for EAD with my I-130 and I-485 because I never expected it to take this long. my I-130 has been approved for 1 year, it’s just the I-485 I’m waiting on now. I applied for EAD 11/3/2023 and my lawyer put in a expedited request with proof and I’m waiting on the response now. if you request the whole thing there you will be able to tell if there is a problem or not. there is a part where it says “case flags” and it will tell you what the problem is, or if there isn’t one then at least you get peace of mind. in my case I was shocked to find out I had a deportation investigation in 2008, I never knew. I just think with delays over 2 years it’s most likely something is up that’s preventing them from making a decision. I was able to fix the problem before it got me denied. best of luck to you.

ya the foia request seems mostly like a bunch of forms and documents. I would have to screenshot or list all the possible things. I didn’t see anything that said case flags
