denied and have 33 days to file motion
All,
my case was denied and I have 33 days or deportation.question:
1-If I refile the I-130 before the delay , can I still use the same pending I-485 or I have to refile for everything again?

I'm so sorry for you @Lil san... yes, indeed. With the NOID, you have to submit EVERYTHING. Even the one you think won't be relevant. With that being said, from the beginning of your relationship. My advice is that, you have to get lost. by that I mean, NO mail received for you at your current address, look for under the table jobs. if I were you, I would have moved out to go somewhere nobody knows for like at least a year or a year and the half. And then, you refile. this time with more proofs, include the one you have been doing with your spouse during that time. The other option is, if you have some issues with your spouse, you can file for Vawa with a competent immigration Lawyer. Goodluck. But in All, YOU HAVE TO BE INCOGNITO for some times.

@Lil san the best is to consult with a lawyer as soon as possible. I my i1485 denied and it reopened with i290b motion. Nobody will come and deport you right away. you are still married with an us citizen.

@Lil san I was given NOID also in December and I have submitted all available evidence documents including pictures since January. May I know how long it took them to deny your case after responding to NOID? I believe the best option you have is to refile. They can’t just put you in a deportation as long as you are still married to a US citizen. but act fast.
