dependent I-485
so I asked emma who confirmed dependent I-485 has been transferred to field office but primary applicants I-485 still in National Benefits Center. two questions 1. is primary also processed within a few weeks apart ? 2. can dependent I-485 get approved before primary’s approval? I saw online this does happen at times - trying to understand if that’s frequent or more of an exceptional case.

@battling giants You're in the same situation as I am (+ similar filing date). I’ve also noticed that my dependent’s I-485 has been transferred to a field office, while my own I-485 (as the primary applicant) remains at the NBC. My guess is that both applications might actually have been transferred to a field office. Interestingly, when we checked again about the location of my dependent’s I-485, few Emma agents claimed it was still at the NBC, which contradicts their earlier response. It’s known that many Emma agents lack accurate information about the actual location of cases and often default to saying the case is at the NBC, even if it has already been moved to a field office. Given that the primary applicant’s I-485 approval must precede the dependent’s, it doesn’t seem logical for the dependent’s case to be transferred before the primary’s.

To answer your second question, the dependent’s I-485 should not be approved before the primary applicant’s I-485. If it does happen by mistake, I’ve heard that, in the worst-case scenario, USCIS could later revoke the dependent’s I-485 approval, which could create significant issues with the dependent’s immigration status.

thanks for getting back on this . so USCIS doesn’t revoke unless there’s reasonable doubt of fraud in the application. I had an office colleague who got an approved I-485 even though his case wasn’t current. he’s reached out to USCIS , senator to check on what to do fearing this might disqualify him for citizenship in future. but they all confirm this unless there’s any fraud he’s all good . also regarding ask Emma’s reliability in the status , I usually keep asking Emma multiple times before their responses average out to one of the answers . example one Emma told me primary applicants case was already at FO but 5 others still said NBC. I’ve heard they just answer FO to applicants who regularly call just so they can reduce their calls . doesn’t effect me
