EB1A Premium Processing: Refund Eligibility for Delayed Response
I submitted my petition on December 13, 2024, under premium processing but have not received any response. Since the 15-day processing timeline has passed, am I eligible for a refund?

For Eb1a I-140 premium processing, It’s 15 business days not calendar days. And since federal holidays were Dec 24, 25 and Jan 1. Those days are not to be counted. if you submitted Dec 13, 2024. 15 days should be Jan 8, I guess. Maybe give it sometime. https://www.uscis.gov/forms/all-forms/how-do-i-request-premium-processing There is a fee to request this service. If you request premium processing, we guarantee that we will take adjudicative action on the case, as described below, within the time periods described below, or we will refund the premium processing fee: 15 business days for most classifications; 30 business days for Form I-765; 30 business days for Form I-539 applicants requesting a change of status to F-1, F-2, M-1, M-2, J-1 or J-2 nonimmigrant status, once all prerequisites have been met; 45 business days for Form I-140 E13 multinational executive and manager and Form I-140 E21 national interest waiver classifications

Have you received your receipt? We submitted our EB1C on 12/10 with premium processing and only received our notice of receipt on 1/3. Your 15 business days only start from the date the notice of receipt is issued.

already 15 business days has been gone but the receipt notice is not yet sent to me.

I recently applied for EB1-C I-140 in premium processing. it was approved after 30 days. PP timelines are 45 business days
Dan DJan 10, 2025
EB1-C is different from EB1-A. EB1-A premium processing time is meant to be 15 business days. @lk s, please get your facts right.

@Dan D you are right.

Ok, but you should have received the i-797C (I-140 receipt) with the priority date, and tracking ID to check your case status, did you get that, and if yes, did you find the fee detail mentioning the "premium processing" ($2805+1K+)? I am sorry if you did not receive any letter yet.
