@lou ma No, I’m still waiting for my I-140… but my application category is E26, because I’m in the US.

@kar C it’s taking so much time, did you file the AOS on the same time of your i140. same here but not concurrent filling … only waiting for the i140, but my PD is one month after you, so if you don’t heard from them, I will probably not …

@lou ma Don’t get confused. the i140-for EB2 - NIW Has 2 types., one for the ones we are here in the US (“E26”) and other one that is for Consular processing. This has nothing to be with the i485 (“Adjustment of status”) We can’t file concurrent for EB2-NIW, because is not “CURRENT”. And regarding the PD, all depends, is not just how strong is your case, but he officer, the Center, etc. there’s ppl with Jan24 date, recently approved. So is not in order or linear.,

@kar C yes I know I am in the US too and I am making distinction between the consular processing and the AOS. you can do a concurrent filling for the EB2 NIW but your PD need to be current. you are right on the point that for all the late application, you can’t do it but it’s not impossible. (I mean legally possible) I am a foreign lawyer and I am just following the case for my husband ! i am not the principal applicant
