What was the date you Responded for First RFE and What was the date when you received second RFE?

first RFE received on 9/18/20 dated 9/11/2020 responded 12/07/20. USICS updated 12/30/20. second RFE received 6/6/22 responded 8/29/22 to extend for 60 days (9/1 to 11/1) and actual response was just mailed on Friday 10/21/22 and received by USCIS on 10/24/22.

It looks like every 6 months of your submission either you will get another RFE or you will get a decision

sorry Dec 30 2020, I’ve just edited it. Just wanted to show the update on the USCIS website took about 23 days to reflect response for the first RFE. Second RFE response was updated online the very next business day. Mailed Friday, received by them on Sat (USPS tracking) and updated online on Monday. I know many of is count days, if not hours for the update online, so I tried to be very specific.

My 2nd RFE, they wanted more evidence of abuse. Once they recv'd it, my Vawa was approved a month later. I'm now on my 3rd RFE..... updated medical exam, proof of covid vaccine & req'd vaccines. I responded a month ago. Still no updates 🤷🏾‍♀️

i wonder how they ask for more evidence of abuse? what more can you add from what you had given them before??? can you resubmit the same thing?? @Kp

I’ve added psychological evaluation and 3 affidavits from witnesses. It was not filed beforehand.

BTW lawyer just cherry-picked from all of my evidence to highlight important points and streamline the adjudication. Feels like he just wanted quality of info over the quantity.

@Jully T, now it makes sense because i was a bit confused why would they ask for more.. but since you had not submitted your psychological evaluation, i can see why they would ask for more.... however, some lawyers advice not to submit all what you have the first time and wait for RFE and then bombard them with everything you have... but to me I think that delays you unnecessarily. I think you're better to give all the ammunition you have the first time around!

@Leo Lance ~ I was thinking the same thing. What proof can I send? You can’t see my damage. I kept hearing: You need physical proof to have an approved Vawa. I have no pictures or police reports. My proof is internal scarring, emotional abuse & financial abuse. My atty didn’t listen to me when we initially sent in my application. I don’t think my proof was even 7 pgs. I kept telling her I think we should send more, she told me no………wait until they request it. After nearly 2yrs of not hearing anything from uscis I got a HEFTY request for additional proof to support my case. They wanted a detailed experience of what life was like living w/my ex, I had to give details of how many sessions I attended in group therapy as well as individual therapy. I had to supply MORE bank statements, which wasn’t easy, as I never had access to the account my ex added my name to. We opened an account at a different bank, which he bled dry & I ended up paying all the overdrawn fees myself & the account eventually got closed. Thank goodness I could go back there & retrieve those old statements to help support my case. I had to write a notarized letter explaining why my name isn’t displayed on the electrical bill, but I’m on the account. I got someone to write a declaration on my behalf about an incident they witnessed. It was so much BS! It makes me angry just thinking about it. All that torment that I’ve been trying to forget is now being dredged back up. All of this could have been avoided if my atty listened to me in the first place. She didn’t even include my psychological exam w/my application! The same exam she stressed & pressured me into getting she didn’t even send it in until last year. 🤦🏾‍♀️When I sent all of that stuff in……..they approved my Vawa the next month.

@Kp, quick question, within the 2 yrs of them being silent, did they send you Prima Facie? am trying to understand with the small amount of evidence you sent initially, if they issued a PF...

@Leo Lance ~ Yes they did. When I filed for Vawa Sept 2019. I got my first PF. If I remember correctly, that was for 1yr. With that, I got my DL, which I didn’t have in yrs. When the PF exp’d, THAT’S when I started experiencing problems w/my atty. She wouldn’t respond to ANY of my correspondence. I was beginning to think I did something wrong. Not sure how, but I just couldn’t understand the radio silence. All I wanted to know was, is the pf being automatically renewed as it states on the notice, or do I need to request it? Rumblings of Covid may have started to emerge & disrupt things. In all that time, all I got was PF’s. I believe I got 4 of them I think. It’s really hard to tell. My atty gave them to me when I only had a month or so left on them. It looks like she wasn’t going to the office to clear out her mailbox! I never got an EAD either. Even though I applied for one. I kept asking her to show me confirmation that she sent the application to USCIS, she never did. I’m just glad I don’t have to deal w/her anymore. She caused me so much mental anguish on top of the Vawa process. $8k for WHAT? Avoidance & incompetence. Sorry for the long response, but it’s such a sore subject for me. I hope to never experience anything like this in my life again.🤦🏾‍♀️

@kP you went through a lot sometimes these attorneys are just after money. whether u filed it urself or lawyers did whatever will be will happen. have seen a lot that filed for themselves and got approved

@babatunde ~ You got that right. I think this broad just wanted money. She didn’t give a toss about my case. She didn’t even tell me about the RFE I got last April. She held onto it until June when I found out about it. I have no doubt about that. No one is going to look out for you like you! We will put more effort into our cases than the atty’s. After you’ve paid them, they act like they’re doing you a favour or you don’t exist. I’m just glad this ordeal is over. Good luck to those still in the struggle.

@kp happy for you that u finally made it lol. I will do it myself and face the reality. I have my stuff ready , evidences, evaluationg report , starting therapy soon, lease and bank statements, police clearance and letters from friends and work place ,just taking my time to write the declaration which people always says is the real problem..

@babatunde ~ You sound well prepared. I wish you all the best. Yes I agree about the declaration. It just dredges up traumatic feelings you know? Do your best & write a detailed letter. Don't matter if it's long. The more detailed the better. When I got that large RFE last yr, they said I didn't talk about what life was like w/my ex. Why did they tell me that? I let them HAVE IT! I described the colour of our house, how many windows it has, whether we have tile or carpeted floors, how many b/rms, what the bath/rms looked like, what size bed we slept on EVERYTHING. I was being really extra! 😂 I'm sure I broke all types of HIPPA laws by telling them which medication my ex takes as well as what he has for bfast! Guess what? It worked! The Vawa was approved the very next month. Take your time & think of EVERYTHING you can to build up your case. Make sure the ppl who write the declarations for you explain how they know you & for how long. You sound like you've got this, but don't hesitate in reaching out to me if you have questions. @KP, it's so strange that they can issue out a PF and yet send you a hefty RFE for things to provide. One would think getting a PF is an indication that what you submitted is sufficient! but wow! they can still hammer you with a heavy RFE despite the issuance of PF. But i have seen people getting RFEs quickly unlike your case took 2 yrs to receive an RFE. Maybe because of the pandemic that delayed things. So far am almost to 11 months since I submitted my case, am hoping am on the safe side since I haven't heard anything back from them. I was wondering if there was anything they needed they would have already requested? but again this office is unpredictable, you can never know 😩😩..so far i got 1 PF and a combo card C09. My lawyer sent everything all at once! 🤞🏾

Leo Lance ~ Ingl……I was shocked that I got a RFE after nearly 2 yrs. Like, what were you lot doing all this time to figure out you needed more information from me? They really do seem under staffed. I wonder how much they pay, coz I’m about to see what positions they have available…..or do you need to be a citizen to work for USCIS?????🧐🤦🏾‍♀️ I’m sure the RFE wouldn’t have been that bad if dipstick had sent more documentation to support my case when we initially filed for Vawa. So all in all I got 2 RFE’s: The first needing more info to support my case & the 2nd one for medicals. As I stated before, the hold up was the pandemic & my atty who wasn’t on the job like she was supposed to be. USCIS does ask for duplicate info though. I think sometimes it’s misplaced but often times, I honestly think it’s for things that are exp’d. Ie: Recent tax documents, medicals, & there’s something else that I can’t think of right now. You’re blessed to have your EAD & combo card. I didn’t get mine until after my Vawa was approved & I was told that I wouldn’t qualify for AP as I over stayed. Like WHAT? Half of the ppl who are applying to adjust their status over stayed. What are you on about????? 😳 On another note, have you noticed the amount of ppl who had interviews scheduled are now being switched to RFE’s? That’s great. I wish they would just go ahead & issue RFE’s for the rest of the time until they get caught up. babatunde ~ I’ve got your email info. Thanks for that.

@KP, yes, they sometimes misplace documents and ending up sending you an RFE for things that you had sent already the first time. Yes, i see people get their interviews waived and get RFE for medicals. That will definitely speed up things!

I submitted and application to Vermont for a vawa self petitioner on September 5th 2022 and to date have not received the receipt it’s been over two months and the USCIS website said that you should have received a receipt after one months

I’m filing for myself because I can’t afford an attorney, I didn’t want to go this route but after what was done to me I was just left high and dry in someone else’s country with absolutely nothing not even shelter
