I-130 (spouse) errors
Hi all,
We've recently filed I-130 online and my husband (petitioner) sent me a copy today. There are a few errors in there:
1. prior marriage end date is repeated for our marriage
2. my phone number is incorrect
3. his work street address is incorrect
4. my prior marriage husband's name is spelled wrong.
We have NOA1. Should he upload a corrected version and signed statement of corrections in the other section online? and then follow up by logging typographical errors to USCIS?
Thanks

we made a few typographical errors on ours too. our lawyer told us to resubmit the pages with the corrections and to then send a page explaining the amendments signed and dated by me (the petitioner). hope this helps!

thanks Nic Lou. Did you just upload them online?
Miguel GaribaySep 26, 2022
I had the same error in the prior marriage, the date was duplicated in our current marriage. I think it's an error in their system because I didn't put the date in that place. I contacted USCIS and they told me to upload a letter explaining the error and submitting the correct data. mark the box on the form you want to fix. (page numbers, part, and box number.) and upload it to your online account as "other" evidence.

Thanks Miguel, do we also upload a corrected form?
Nic LouSep 27, 2022
@Angela Caine yep just uploaded it online, as "other" evidence, as @Miguel Garibay said. it must be a glitch because the prior marriage end date also duplicated for us. I just re-downloaded the specific pages I needed from the I-130 form, made the corrections, created a word document explaining the changes (included my signature), merged all pages and uploaded as one pdf with my name plus amendments as the file name.

thank you @Nic Lou. How is your application progressing?
Nic LouSep 27, 2022
@Angela Caine slowly haha. PD Oct 3 2021 Potomac. Active review since April 9th. I'm a US citizen married to an EU citizen and we both live in Europe. I'll be moving back to the US in a few months for my work so we're hoping for something soon ๐ฅฒ What about your case?
Angela CaineSep 27, 2022
We've only just filed. USC for UK citizen. We're in for the long wait unfortunately. We're preparing to file K3 too. We're at Potomac also. We haven't had 1st AR yet so hoping we'll fix these errors before they're an issue.
3rd Oct 21.... you should be due 2nd AR very soon ๐๐ค
Nic LouSep 27, 2022
ahh my husband also has UK citizenship. sometimes wonder if he should've applied with his UK passport rather than EU. I've heard it goes faster but who knows at this point. K3 is the fiance visa but once you're actually married right? Think it's smart to file it at the beginning because I've read the wait is much shorter. Are you both currently in the UK then? Hoping for that second AR and hoping your case goes smoothly...don't stress too much about the errors. the lawyer told us they're generally not picky about minor typos.
Angela CaineSep 27, 2022
Unfortunately we're having to live in separate countries for now. We'll close the gap when it's our turn I guess. Yes, the K3 is the fiancรฉ visa for spouses.
Thanks for the reassurance re: the typos. When it's this important you tend to panic more than is probably necessary ๐
Nic LouSep 27, 2022
@Angela Caine, oh I understand the panic for sure ๐
best of luck with everything, heard the K3 takes about 8 months ๐ค๐ป
Angela CaineSep 27, 2022
thanks.
one last question: We're re uploading only the amended pages. Do we also need to re-upload the last signed page even if it's not changing?
Nic LouSep 27, 2022
@Angela Caine just found the email from the lawyer (did this back in April) and she said this: I would submit the actual form page with the corrections and also a signed declaration where you explain the errors that you are correcting.
So I don't think it's necessary :) I'd just include your signature, electronic or manual, plus the date at the bottom of the declaration. that should suffice and that's coming from an immigration lawyer!
Nic LouSep 27, 2022
as @Miguel Garibay said, I included page, section, and line on the declaration. so, for example: page 3, section two, number 1a. I redacted end of marriage date to John Smith. We are currently married.
And so on with the other errors.
Angela CaineSep 27, 2022
thanks. that's what we're doing. just typing the letter now, as you suggest, with page, part and item number: details of the amendment.
thanks so much
