I485 denied while i140 denial appeal is pending
My I140 was denied and my lawyer appealed the denial with I290B on November 2021, yesterday my concurrently filed I485 was also denied. I haven't received the denial notice yet.
Do any of you happen to know from experience how long does it takes to get a decision on I140 denial appeal? Also, can we appeal the I485 denial based on pending I-140 appeal?

why not just file a new i485 once the i140 is overturned. it should be easier then having to do an appeal

They denied my son yesterday too an say that they can appeal but they are Stating the reason for this denial is that his wife didn't submit any birth certificate or their marriage certificate and that a mistake make by them we submitt everything in the first package then they asked for further more evidence we send exactly what was needed but someone didn't spend the time to find the first set of documentation and put them together they denied him but we submitt every paperwork that was requested so we got a lawyer yesterday and we are reapplying instead of taking the appeal offer the lawyer think that best way to go

Deion for you the appeal would be faster because you can state the error then expedite it they will catch their error and ask for your money back if it’s uscis error . if lawyer told you to file over if that’s the lawyer you used at first then maybe she didn’t submit the documents

@Deion, if it's an error from them, your lawyer should write them and point to the error, they will reopen your case.

o yes I know it's an error from them we are on it we submitted everything to them the wife birth certificate and their married certificate so uscis blunder

w moo I know it's an error we submitted every documentation and when they asked for further evidence we send exactly what they needed nothing extra so they should spend the time and find the couples rest of documents that they have in their possession and including evidence which they requested she send it to them

@J A I140 was denied stating beneficiary experience was not stated on PERM labor certification (It was in fact included in labor certification) and hence the job experience letter from employer in itself is not an independent, credible and probative evidence, something in these terms AFAIK...
