@robin h What was your process like? Did you have to wait till I-360 to get approved to file for EAD or I-485?

@j da Silva don’t I have to wait till my I-369 is approved to file for EAD? right now I only have Prima Facie which means that I get public benefits. and my biometrics were used from when my DACA was last active in 2018 so I didn’t have to go in and retake them. but last update u have from USCIS is Sept 2022 saying fees were waived and biometrics are being used from last application. I haven’t filed my I-485 so I can’t apply for I-131 under C-09 Category right? my lawyer only filed I-360 and nothing else. my case is solid my ex wife broke into my apartment one day drunk and beat me with bottles left me in bad condition and got locked up with a felony charge that day.. I assume they should be expediting my kind of cases?

Has anybody tried writing a letter to congress or USCIS asking to expidite their process?

@C M some people did all of that. It worked for some people, for some it didn't. Every case is different

@C M I tried congress man, they called the USCIS but they responded that the case is still under process. they informed every 6 month they send a autoatic letter based on this case. It didn’t make any impact. I have been waiting for 5 year+ now. it’s insane

I only applied VAWA only and after 3 years it got approved. once approved I was able to apply for I485 along with my approval letter and my I485 got approved after 5 months

@bless Emma we share same PD but u know how they say the i360 when filed takes the priority date of the i130 originally filed…. after everything I’m seeing I’m thinking they don’t work like that. my case updated to “correspondence received USCIS reviewing case” and not or my lawyer didn’t send in anything since 2023…. anxiety has taken me over!!!!

@Kaye Duncan @C M my case update they reused my old biometrics from since 2020 that’s update was may 2023 never hear back anything I went my lawyer last month she told me no update yet on my case I have to wait because everything slow up now sometimes I cry & tired wait since 2019 I start my process but my previous lawyer mess up everything for me but I never give up they lord will bless us all & approve us 👏

Applying for I-485, I-131, and I-765 concurrently with I-360 depends on several factors. 1) Were you married to a US citizen or GC holder? 2) If it is a US citizen, Are you in removal?

I never in a removal order or I would have mention it .. yes my husband is us citizens when I get marry to him but my previous lawyer was just taking my money doing nothing good then send send RFE to summit within 32 days & she summit it to wrong department I change and take new lawyer & file VAWA because my hubby start treat me bad & hit me so I move out & that’s how I file VAWA 2022 but I’m not divorced as yet

@bless Emma I’m sure everything will be slow down now… the waiting is so cruel and then the level of my anxiety keeps me up at night and drains me mentally during the days… I feel so unaccomplished and caged…🤦🏽‍♀️

Hello, it depends. If you don't have permanent bars then you should send I-485. As far as I know, only when they approve I-360 they will send you everything else but if you were eligible for DACA then your lawyer should of consider sending all forms. My case has been since April 2022 on 'case received' haven't received anything else than just biometrics. I will apply for I-485 when I get the approval since I have a permanent bar, that's why we didn't send it together so is best if you get a FOIA with your lawyer and determine which forms you can send that they are highly to get approved.
