first they need to get marrie. b he can’t because he is illegal she needs to get green card. first and then ask for him later then is going to be a long process maybe he needs a waver. this is a question for a lawyer not lawfully.

I know, my friend also said he talked to a lawyer, but he's saying that the lawyer said he can. I have never heard any case like this, so I'm just trying to see if anyone who knows about this here instead of asking my own lawyer because it's not my case.

green card holders can do 601a waiver. and interview at home land embassy. that very sample. but taking forever now days.

@br Rubios Right. Assuming the girl gets her work Green Card in 3 years, they still gotta wait 5 years for her to get her citizenship, then apply for his green card +601a waiver.... wow I'm assuming it'll take around 10 years for him to attain a lawful status 😵 sad for them.

@Unicorn S they can get married and her company can sponsor her gc. it will take approximately 3 years to get a gc and then they can apply for I-130 and after approval which takes average 2 years for LPR they can file for I-601a (inadmissibility waiver) it's taking approximately 44 months these days. if it's approved he'll have to go to his country and get gc through consular processing. or after gc she can wait 5-6 years to get a citizenship and then submit I-485 for him. I'd suggest them to try Canada instead of wasting 10 years in hope one day he'll get a gc. Also he can be put into removal proceeding during these 10 year period and may get deported 😬

@Unicorn S I’m curious about your heading but anyways, illegal immigrant are people who don’t have a port of entry meaning they didn’t came through the airport on a visa and undocumented immigrants are the ones who came here on a visa and overstayed so which one is the person? I think you should book a consultation with a immigration lawyer and get clarification because immigration is very much unpredictable these days and every case’s are unique, sometimes it may take less time while it can take a very long time, recently they extended this long process time but really for a fact it is just for people not to able to reach out to them through inquires when their applications pass processing time. So book a consultation with a lawyer because everyone experience is different.

@Unicorn S unfortunately, there isn't. she won't be able to add him to her petition as he's an overstay (I assumed he's an overstay) forgiveness only for immediate relatives of USC not LPR. if he's been maintaining his status here there won't be any issues to add him to her petition. a friend of mine is experiencing the same problem. the difference is only she already got a gc at the beginning of the year. and now they regret they didn't leave the us and tried to go to the different country because now she has a good job, kids and house. and he's not able to do anything. his hands are tied for the next 5-6 years.
