My petition got denied
My petition was denied, and I’m unsure about the next steps. I collaborated with Ashoori Law to draft my petition for a mobile application designed to help alleviate vertigo symptoms. I submitted four recommendation letters, including one from a licensed physical therapist who stated that my idea has potential, yet it was still denied. I have not received the details of the denial at this point. I feel indifferent about the situation and am uncertain about what to do next. #eb2 #niw

@Mrs Mrs is it possible if I can appeal? The issue with refeiling my case is because of the priority date I might lose.

@mayowa Paul You can appeal but appeal have a way lower approval rate than refiling except you have a very strong case, like it is really of national importance and you are one of the best to do it and you believe you shouldn’t have been denied.. If not, it is a waste of time. Am saying this because a person way higher than the officer who looked at your case, usually a director look at the appeal. Appeal also takes a very long time. You can both appeal and refile if you want.

I’ve now received the full denial notice, and after discussing with my lawyer, we’ve decided that appealing wouldn’t be the best option due to the low success rate and long processing time. The main issue with my petition was that USCIS wasn’t convinced of the national importance of my business venture and didn’t see enough government or industry backing. My lawyer suggested that instead of refiling under the business approach, I should focus on my expertise as a software developer and reapply in the future based on that. For now, I’m focusing on securing my H-1B as my primary path forward. If that doesn’t work, I’m also looking into alternative options like Canada. It’s a frustrating process, but I’m trying to be strategic about my next steps. If anyone here has gone through something similar or has any advice on the best approach for refiling or alternative immigration options, I’d really appreciate your insights.
