N400 and Traffic Citation
Hello. So If you have had a traffic citation and it got dismissed by a judge. How do you go about this when applying for N-400? There’s a place it asked if you have ever been arrested, CITED……. After ticking yes ( Because of citation) , it further asks you to provide evidence of arrest but what to do you do if you have never been arrested. only cited and it later got dismissed.

you dont need to mention because you are never detained or arrested. traffic ticket is not criminal act unless you are handcuffed.

okay, this seems to be have a divided opinion as to whether to include or not. Do anyone of you know what the rule/law actually is, regards to traffic citations that are later dismissed.

I once had a traffic offense. to Appear at court. my case was dismissed at the hearing. my immigration lawyer didn't put that in my application. he said it's was dismissed. it's no more in my record

Traffic violation is classified as either a civil infraction or a misdemeanor, depends on your state laws. You must include the violation on your N-400 because you are under oath to provide all information truthfully and to the best of your knowledge. Part of your background check is your driving record and they will know about it when you go for interview. If you fail to mention it, the officer will ask you if there's anything you forgot to add and once you tell them about the ticket they will ask you how fast you were going and where did the incident take place and what was the outcome. They will note it on their computer and move on to the next question. That happened to me, I forgot to add a ticket to the form and when we got to the part where I have to disclose it, the officer asked me if there's anything I want to add or if I forgot to mention on the N-400. It didn't effect the outcome of my application because I was approved and received my naturalization certificate.

disclose it on the application if the fine was more than 500$ . if it’s less , you don’t have put it in the application but disclose it at the interview and tell the officer how much you paid and how it was resolved
