N400 Form. What Martial Status to Choose?
My wife and I have been separated because we’re going through rough time, but we still filed taxes together. The N400 form has an option for Marital Status "Separated". However, we live in Virginia, where there isn't a separation legal court order. My fear if I put separated, they will request some type of court order or will assume that I should have one. What should I do? There is an option that asks if we live in the same address, and we’re planning to say no to that tho. #N400 #naturalization

@Al A Are you divorced? if not then you are still married. As long as you are not filing N-400 under the three year rule then it is immaterial if you are separated from your spouse.

@Rocco Forté I’m separated from my wife and our divorce is still pending. can I file N400 under the 3 year rule?

@Dee accomplish You cannot. The law requires that you live in marital union with your spouse until you are sworn in as a U.S. citizen, if filing under the three year rule.
