Notice of Intent To Deny NOID EB1A
Hello everyone, I recently submitted my EB1A application for premium processing and received a Notice of Intent to Deny (NOID) today. The NOID letter states that my application does not demonstrate the high level of expertise required for the EB1A category. In my application, I attempted to meet 7 criteria. The reviewer validated that I met 4 out of the 7 criteria but provided detailed feedback on the 3 criteria I did not meet. Despite meeting 4 criteria (when only 3 are required), the final determination stated that I have not shown I am among the top 10% in my field as required by EB1A. I would greatly appreciate your advice and expertise on how best to respond to the NOID. What evidence can I provide to strengthen my case, especially considering that I have already met more than the minimum number of criteria required? Any resources or pointers is really appreciated. Thank you for your help.

Your attorney should be able to respond to the NOID by stating the relevant regulations and how you satisfy them and also supplement any additional information as he/she will think relevant to support that letter and your application.

hi Liz, sorry to hear that. talk to an attorney on how to respond to NOID. the EB1A needs two parts in the application, 1. minimum 3 criteria and 2. is that it should support your application in totality. So, when you speak to attorney, make sure they look at 2 and support how those 4 criteria, support your application in totality. hopefully that should clear it. All the best. thank you.

@Liz Hay Wow, what you say is surprising, because the EB1 (I took the A) is just about meeting 3 criteria out of 10, I suggest you breathe, calm down and read the RFE in detail, it usually says what they ask you to demonstrate to an approval. Something you can add to your response is to demonstrate continuity in your career. You can also add at least 3 letters of recommendation about the extraordinary nature of your work from people who have worked with you and have a profile similar to yours, and finally , a professional plan to develop here and that contributes to the country.

@Liz Hay Good luck, I hope they approve it, I also did it alone, but when I had any questions about the process I made inquiries on the program of some lawyers called Beltran Brito Casamayor, look for them on YouTube, they are very good, I understand that they also help with the RFE, maybe you can consult.

@Liz Hay The firm is Siskind Susser, our lawyer is James Hollis 901-682-6455. Our case is a bit different than yours, but I think it would be important to asks for advice since USCIS challenges criterias these days.

@Liz Hay happened to me. i was given 6 out of 8 and rejected on final merits. i drafted my own cover letter and argued on final merits and sustainable national acclaim. followed below format for arguing final merits. reapplied after rejection in 5 days and got approved in 7 days. lost 3 months priority date though https://razvanmarinescu.github.io/green-card-I-140/

hi Liz, i am in the same situation as you, 3 criterias were accepted and i was challenged on Final Merits, got NOID, my attorney send response to NOID yesterday, may i know what happened to your case?
