Predictions
The Final Action Date for EB3 Other Worker has stayed in the year 2019 2020 since June 2022. It’s been 19 months since the retrogression happens and now some predictions say that it will take up to October 2024 to process to whole year 2020. So does it means they spend the next 8-9 months to process the months October, November, December of the year 2020. How huge are the backlogs that they have to spend so much time for that? Would there be a big jump happen in the end of the fiscal year 2024 or beginning of the fiscal year 2025? Since they stop accepting new applicants since February 2023. By the month February 2025, Would they clear the backlogs and start to accept new applications? Look at the visa bulletin in the past every beginning of October it would be current again. I don’t get it when they approved a lot of I-485s for EB3 Other Worker in the year 2022 but still getting backlogs back to 2020? If this October 2024 or January 2025, the final action date for this category won’t make a big jump. I think USCIS would purposely make this category dead and we are the victims for starting this processing. My PD is Sep 2021. Anyone gives me your analysis for the upcoming visa bulletin in October 2024, I appreciate it.

@scjn 97 sounds very reasonable for the your predictions but the waiting is really killing me. By the end of this year of 2024, it should be somewhere in mid 2021, also I knew a bunch of lucky people get their green card in 2022 with PD in 2021, hopefully it would deduct the line for our Sep 2021 too be current sooner. My PERM got 6 months to process, how long is yours?

@scjn 97 it is really unpredictable with USCIS, my friend got 2 interviews, one in December 2023, and one in this February 2024.

@scjn 97 he said he did not know why, but for the first interview he said it went quickly around 10 minutes, they asked him questions that he did not provide them in his I-485. Now he prepares for his next interview next week.

@scjn 97 There are a question about him attending military in his country and they asked him about that, another one is something that he forgot to tick a Yes or No question in his application but I didn’t know what exactly that’s question is about.

@scjn 97 he forgot to answer 2 questions in his I-485 application and because he attended military in his country, so he asked more details about him being in military back when he was in his country

@Bullshit Based Category (BSC) I think they may get to your PD this October 2024 or Jan 2025. They should make a big jump as a new quota for the new FY, if it is not current , it should me to mid 2021 as I knew some people PD 2021 got their GC fast in 2022, so they can make the line shorter for us.

@scjn 97 yeah, it’s rare, he is the only one I know have 2 interviews.

@scjn 97 I started to work for my sponsor since January 2023, I think you are the same, it is more than a year now and I am still working for my sponsor. I hope some big changes in Oct 2024 or at least Jan 2025, I suffered from waiting for this GR for while long since my friends who also had PD in 2021 but they got their GC in 2022, 2023. I didn’t expect they spend that long to issue cases in 2020.

@scjn 97 I am not sure about this but I read this from USCIS Question and Answer. Finally, a noncitizen with a pending adjustment of status application based on a prospective job offer may be unemployed while their adjustment of status application is pending and, depending on the facts involved, may remain eligible for adjustment of status. However, a period of employment in an occupational classification different from the prospective job or a period of unemployment may affect a noncitizen’s current immigration status and could raise doubts about the continued validity of the job offer and/or the noncitizen’s intention to accept the offered position after adjustment. @scjn 97 I think as long as you can prove the validation of your offered job in the future, you are good to go. But I really don’t know man, their explanation for this is so vague and not clear. I always like no one knows what it is actually happen with USCIS.

@scjn 97 If it is too long you can change your sponsor by filling an I-485J with another employer with similar jobs. I am also very desperate for working for my sponsor but I think I would wait until this October 2024, if the PD stills not change much, I would have to find some ways to not working till dead for a green card because working for 2.5 years is too much. Let’s see the PD for this April 2024. it is a new quarter. Hope to see some positive changes.

@Vitaliy 123 Nobody wants to be a victim of this retrogression, USCIS needs to speed up the processing
