RFE on I-140. EB2-NIW
Hi guys, I applied for an EB2-NIW in May of 2022. I received an RFE on my I-140 on November 2022. I replied the RFE in march of 2023, almost 5 months and still waiting for an answer, any ideas? suggestions?, similar cases?Thanks.

@olu mikk I was on time to respond because in that moment applies an extra 60 days for the COVID-19 politics. But you’re right, in this moment only 3 months to answer to a RFE.

The normal time to get a response from a RFE is 3 months at most + 2 months (Covid-19 Politics). I think you will get a response until 2nd August.

@Juliano Murlick I also got this information from my lawyer. Some ppl are waiting for more then a year and some of them got a denial after a year RFE response was submitted. You are saying that ppl wait "at most 3+2 months". It's not true because some ppl are waiting more than a year. Your are giving Che Pe a hope that he can get it soon. Just use a real solution, not estimates. No need to wait for unpredictable amount of time.

@Artur D the thing here it’s that my lawyer think that PP it’s not a good idea, and could harm the process in a bad way. It could shows that I’m desperate (thing that it’s true 😂) but we doesn’t want that they know about it. so as @Juliano Murlick said, I preferred to wait and keep my hope to August 2nd. o similar…

I filed mine in January 2022 RFE in June, Replied in November 2022 still waiting
