follow, I just submitted my marriage case but didn’t apply for ead and AP since I have approved EB3’s ead and AP. I wonder if I can use that ead to work for any employer?

@A V I had eb3 Ead but AP wasnot approved at the time when filed marriage case. my lawyer recommended to file new case with everything again so new ead and new AP. i started working for new employer once the EAD approved from marriage case. so am not 💯 sure if you can work for any employer with that EAD. did u transfer the case ? Or applied new one?

i 485 can be based on only of the either case. if it is on marriage based one, there should not be any problem to travel even if you’re fired/employer withdraws the application. you can transfer between the bases later. AFAIK EAD and AP are tied to the i485. so if you move from employment based to marriage based, then those should carry over as well.

@monica den i keep my eb3 active and apply for a new marriage case. @m t hi m t so you mean I can still use my eb3 ead to work for any employer?

@A V if u have kept the eb3 active, i would have applied for new EAD and AP. but if u have transfer the case you can use the old ead without a problem. i think thats what my lawyer said. but i would ask a lawyer or maybe u can apply for EAd now also.

you can travel , no issues at all , just u will be going for a secondary check

@monica den thank you. I filled out the application myself. I have question, on the current status question on I-485, I wrote EB3. I’m not sure if it is the correct way to answer that question.

@A V i dont think mine we put Eb3. eb3 is not status. Most likely on mine its F1, because i was still maintaining f1.

@monica den oh ok, I dropped my F-1 and worked for employer for almost 2 years, I guess I will just have to wait if they send RFE with more questions. are you still waiting for your GC, how long have it been?
