unfortunately you’ll get the C31 once your vawa is approved only the C09 category allows you to work while your i-485 is still pending

@cape boy uscis doesn't change c09 to c31. these are two different categories. C31 is for people with approved vawa

I suggest you refile form I 765 by itself.

yes USCIS changed my lawyer filed c9 but USCis sent receiet notice with c31 and also I have prima facie because my married based 485 denied then I filed new work permit and advance parol while my vawa pending

@cape boy point of correction, you did not get prima Facie because your married based i485 was denied. you got it because at the first glance of the document you sent with your vawa, the officer has determined that you suffered abuse. that doesn’t mean they can’t ask for more document or clarification along the line

your lawyer made a mistake. he filed your I-765 under C31 instead of C09, he is just not being honest with you. You can file a new I-765 under C09 without your lawyer.

Secondly like @az az has stated here, you lawyer didn’t file C09 for you and USCIS won’t and does not change filing category for applicants or petitioners. You lawyer marked C31 Employment authorization for you on the Vawa petition form he submitted. He didn’t fill out an I-765 form for you. I have addressed this in a post you made with a different heading a few days ago and instead of you acting on it, you are reposting the same thing in a different way. Take action and stop dancing around asking the same thing in different ways.
