WILL I HAVE ANY ISSUE ON REENTRY TO US IF I PREVIOUSLY RECEIVED A DENIAL LETTER ON MY MARRIAGE CASE BEFORE I FILE VAWA
hi guys i have a planned trip on May and i am travelling under approved AP. This is my first trip ever with AP, Im quite anxious because i have filed my vawa application 2 months before the 2 years standard limitation of filing after getting divorce so im worried that because of this record of overstaying, they will use this against me to get denied on reentry, especially i also had a history of overstaying 2 years before i get married in 2021. I also recieved a denial letter because my spouse withdrew our application prior to our scheduled USCIS marriage interview. i dont want to get you all confused with my story but i just want to ask if anybody here has experienced of travelling with AP under vawa while also have received denial letter in the past. I also never recieved a notice to appear, removal order or deportation letter. and i dont have online record of that as well base on my lawyer. its just a denial letter saying that they are denying me for the adjustment of status during that time. I came from abusive marriage and i only filed vawa 1 and half year after our divorce. As what im hearing from people who travelled with AP, there are some who also overstays but were able to comeback with no issue. I would totally appreciate any positive thoughts on this. Thank you in advance

@Lee G you can travel without problem, i have friend in same situation he traveled without any issues as long as your i485 is new and based on vawa.

don’t leave wait till you get back a different travel document they can see everything in the system

@Lee G I travel 5 times within a year and I had a denial filed my vawa a year after the denial and I came back perfectly fine

I would not recommend anyone with AP to do international trips at this time. you might want to wait for this administration tension to cool off. if the risk is not worth it, don’t take it.
