I had seen someone say he/she had to write a letter stating that EB1A doesn't require i485j and included the printed USCIS website that says that.

people still get denied even after providing the evidence from USCIS website.

We got an RFE (Supplement J) on EB1C. It was streight forward response. Waithing on approval over a month as of now.

AFAIK, EB1A doesn't need to provide i485j after switching jobs. Although, your i485 receipt notiçe may written to provide i485j, but that's a standard line used by USCIS for all. USCIS will give rfe, if they need it. it'll not affect your çase at àll.

@Mel mel I got the same RFE on EB1A, I have responded with a cover letter quoting the EB1A regulation that a job offer is not needed, I also included the i485j instructions page that shows that it does not apply for EB1A. But also added that I have a job and not at risk or becoming a public charge with W2 and pay stubs. I haven’t received my response yet but my bet is that it should be okay

are you currently working? cz they won't send that if you attach a verification of employment as part of your evidence

@49n3r . yes I’m currently working and an employment verification letter was included in the RFE.

if I understand you correctly, you did not include employment verification at first? I mean when you initially submitted the i-485?

@VTGC Greencard I sent a second RFE response today and included the signed supplement j. My employer agreed to sign.

@49n3r . In my case I had included verification of employment, pay stubs and even W2 in the first place, still got the RFE. I responded with additional info without having my employer complete the J because they weren’t involved in the first place and they’d start a long story about legal reviewing my entire petition etc. Hopefully USCIS accept that I wasn’t supposed to complete J in the first place and approve my case.

@VTGC Greencard ok that is just weird. I guess my argument breaks down with you ^^. well I hope they approve your case, and when they do, please add a comment here.

@VTGC Greencard one question though, your employment verification letter was it a signed letter from your supervisor (or whoever is in charge) with a recent date or was it an employment letter dated some time back. The reason I ask is cz if it is a letter with recent date (by recent I mean around the time you submitted) it certainly won't make sense that they request a supplement form

@49n3r . It was a signed recent document same week as when I signed and sent the I485! It was a very shocking RFE to be honest
