Advisory opinion J-1
Did anybody request an Advisory Opinion? How long does it take for them to reply? Uscis sent me an RFE asking to prove I am not under 2 years home residence rule after J-1 work and Travel, and I lost my DS-2019 where it shows that info, and it is not mentioned on my visa, so I had to request an Advisory opinion, however I have to respond to USCIS till April 25th so I am wondering if there is a chance to get an answer before due date.

usually 2-3 months. you have time but better that you request expedite

what was your form? I485? I have my J waiver pending and I am thinking to file AOS. J visa is expiring soon. at what stage did they issue you an RFE?

@blue bird yes, I-485, AOS, marriage with US citizen. They asked 6 months after interview

i had to request 3 advisory opinions. two were in almost 2 months, the latest took 20 days only. but these days DOS is taking more than a month to just show up the documents on their website. you must file as soon as possible. if appraoching deadline, you may request to USCIS to extend RFE deadline by showing your proof of online opinion status. they may or may not approve

that is probably what I will do. why did you have to request 3 opinions if mind me asking ? they may not give an answer from the first try?

I had two j1. i didn’t receive response for 1, for rest two I had to ask about both j-1.

I was under J1 for two years back in 2008 to 2010… I was subject to the 2 home residency rule… I lived 1.5 years in my home country. then in 2012 I got a F1 visa so I didn’t finish my 2 years but overtime I did accumulate the 2 years when I visited my home for a month or weeks. I submitted all that when applied for greencard. right now I’m waiting for my interview… I’m surprised I didn’t get an RFE yet.

@denis better don't wait for RFE and bring all possible proofs on interview. They sent me RFE 6 months after interview, I could already be wit green card, lol

oh wow… that’s crazy! what proofs didn’t you have? I am married to USC with almost a baby… I should bring more evidences that I completed the 2 years… as far as I know it is cumulative. right?

I don't know if that's cumulative...that's something better to ask a lawyer. But I didn't have a proof that I am not a subject to 2 year rule and that exactly what they requested.

go straight now and apply for a waiver if u were subject to 2 year rule.
