My case is also filed in EB1C and my I-485 was transferred to NBC in Sep 2022 since then there are no updates. There are no timeliness defined my USCIS as per the USCIS case processing timelines this will take approx 20 months based on which field office the case will move further for final decision

I think i485 approvals will happen faster now for those who have current Priority date. ie. Feb 1 2022 or earlier. the slowdown last quarter might have been because of the increase eb1 application being filed in H2 2022. which is also the reason I assume the retrogression happened. this might help people like us who submitted our docs much earlier.

I wish, my filling date is in Dec 2021. Let’s hope for the best 🤞

AA - 765 and 131 can progress. infact there are many instances where the 765 got approved even before the 140 was approved

AA - I-140, I-764 and I-131 approvals process happen in parallel. once I-140 and I-765 are approved one needs to wait for AOS via 485. Please do note once I-140 ,765 and 131 are approved and 485 has been pending for more then 180 days, the situation is almost like having a virtual GC

ya there is some truth to it as rfe is a way for uscis to buy extra time . hence I m not sure if I want to apply for premium as I have already waited 2 months and I was hoping that based on latest trends my I-140 will be approved within 3 months

hi all. I have a situation. I need to travel to india in the month of May due to emergency . I am yet to get my EAD and AP approved. When I spoke with my attorney they mentioned that my AP would get denied if I travel before that time. is there any chance my EAD and AP could get approved before May 15 so that I can go and book the flight ticket. my PD us 5th October 2022 and I got i140 on 3rd Jan 2023

AA- going by trends EAD might get approved but AP approval is highly doubtful. why don’t you plan to use ur current visa ( h1 or l1) for the travel ?

My AP got approved 10 days before but still I didn’t receive it yet? Is this normal to get approved and take longer time to actually receive it?

no that makes no sense! if you do travel outside then only the I-131 gets rejected as you will get a new I-94 when you return. I would say keep aside your GC process and ask yourself if you could return just using H1. H1 unlike F1 is dual intent visa and there are no issues if one has a pending GC process going on .

AA not disappointing you but like Andy said we can't be sure of AP approval..for us we got our EAD within 6 months. but haven't got about APs yet..travelling on your existing visa is an option but attorneys say different opinion about that as well..our attorney discouraged us from travelling while GC is under process..not sure of the logic behind it though

I was tempted by doing PP but decided not to do it as it’s close to the 3/4 months it usually takes to approve a i140 case in NBC. Fingers crossed.

yea @c s hang tight. given you are within the priority date cut off date ( Feb 1 , 2022 ) AND you’re case has been transferred to an NBC for ‘speedy’ processing ( that’s what they say on the notice )… I think you should get it really soon. anytime now really.

mine is pending since nov21 and at NBC for over 4 months now yet to get i131 or i485 approvals have escalated but of no results and it is frustrating
