F1 to green card through marriage
hey guys i am a F1 student still going to school I applied for a green card through marriage I didn’t receive receipt number yet my wife she is a green card holder do I still need to go to school or i can stop going

Hey Tom, i’m in the same situation as you. My lawyer adviced me to go, because we have to maintain legal status in order for the process to go smoother. When your wife gets her passport, then you can skip going to school and not have any problems, hopefully.

Wish I had an answer for that, it depends. My advice is, continue going to school and keeping F1 status as long as you can. Hopefully you’ll hear something before your visa expires

Always maintain your F1 status. Take less classes / workload, but always maintain your status. Never risk it.

Hello Tom I'm in the same situation like you, but I think I'm going to quit school because I have a young child and I'm expecting another baby so it's hard for me. I got my receipt and I'm going to send it to school. My husband is waiting for his interview to become citizen.

if you sponsor is green card holder then it's better to got to school and maintain legal status but if your sponsor is citizen then you might skip school because you will because immediate relative and there is no cap for visa number for them.

hi guys I’m on the same boat. my lawyer advices me to keep going to class even when I am married to USC . my Pd is Oct 2020 I did my bio feb 2021 since March my case is ready to schedule the interview and today I received my EAD/AP so I think will be better maintain the legal status because pending doesn’t mean approval . it is my personal opinion.

I'll advice all of u guys in school to maintain ur student status until you get ur I-485 approved. Bcos ur journey to citizenship will be connected to ur legal status when u get ur green card. If u stop schooling u will fall out status and when u get green card it means you're illegal when receive ur green card. Pls watch it.

Misunderstood. Being in school keep u in legal stay (staus). Being out of school makes ur stay becomes illegal.

the moment that u have entered into a marriage with a USC your status stays in the legal limbo as also at the time of Gc approval all your red flags, excceeded days etc will he cleared out of the way.. Everyone would suggest u to keep and maintain your f1 status however if you dont have money to followup with education make sure that you have your receipt number, your Aos and Ead and drop school in the worst case scenario or the i20 gets terminated if you dont go to school. however at the interview they have already checked your status and u wont have issues.

hey Tom I am also an F1 student I am married to a US citizen. I am at the very end of my immigration path to get a green card. I have the combo card and my I-130 got approved after I had my interview. Still don’t have any updates about my I-485 for a decision. My lawyer advise me to still on school so it doesn’t affect me at the end. let’s say if you attended to an interview and you don’t convince the officer and they ask you for a second interview or they deny your application for X reason, you still need to maintain your status :) . in the case they deny you can still reapply or appear your case.

@la kaK you can stop the negative comments about us offering our opinion anytime SOON. We’re not forcing the guy into anything, just sharing our experiences and what we know about the questions raised. And we also might have problems keeping up with money to pay for school, but at the same time, you knew you would the moment u entered the US with a student visa….With the intention to study, no matter what happened in the way, cause sure, life happens to all of us. A bit tight on the budget now, for a better future. We will all still need the school for better job opportunities and overall, so its not only for legal purposes, but for the GREATER GOOD!
