I-485 Pending at NBC after Biometrics since Sept 2022 (EB1-C)
Hi Community.
My PD is 03/29/2021 (I-140 filed, standard),
I-140 approved (EB1-C multinational Manager) 04/30/2022;
I-485 Submitted 08/04/ 2022 along with EAD form and Medicals;
Biometrics completed on 09/08/2022;
Case status since then is "Case Was Updated To Show Fingerprints Were Taken"..
No update since then . My notice is MSC22906**** . It has been with NBC all along.
Does anyone has any idea when I can expect the EAD card and GC? Thanks community. #EB1-C #I-485 processing #EB1

We have similar timeline. I have chatted with USCIS live agent twice and they keep saying my case is being processed normally at NBC.

Community - Today ( 10/17) I see that my I-485 (only , not I-765) or me and all my dependents have been transferred to another office (from NBC) and that I should receive a notice in mail soon. Not sure what it means - an RFE coming soon ( I submitted my medicals with 485 app) , OR good progress being made on our case.. Any similar experiences people want to share ?

it means you guys case has been moved to the field office for adjudication. It’s a good progress. You will get the transfer notice in the mail.

@vin ken I have a similar timeline as yours. case filed on Aug 19 2022, finger prints taken Sept 22, 2022 @ NBC all this while; medicals submitted concurrently. No status change so far. 60 days since I485 filed. #eb1-2. Fingers crossed! please update with your status as it changes or GC approval. Thanks for sharing ya’ll experiences.

@pr g - Yes, medicals were submitted together with my I-485 back in early Aug, and it has been at NBC all along, until yesterday. So the Hope is that it will soon be adjudicated and we get greened.. But I asked my lawyer as to what this means - and they said "absolutely nothing, just that my case is processing normally". Apparently it happens all the time as work load in one office increases vs the other- they transfer cases. Let's keep each other posted on the progress.

Hey All - I just saw my status got updated again today ( after yesterday being updated to "case transferred to another office") to "Case was Transferred and A New Office has Jurisdiction".. I find it strange.. Did anyone know what it can possibly mean? or has anyone else been in that situation?
While no movement on EAD I-765, which still says "Case was updated to show Finger prints were taken "

@Vin Ken I'm curious to know where your case has been transferred to. And the status you see is standard. There is typically 2 case status update for transfers but it's just the same transfer.

My case got transferred to NBC in September. I'm still waiting. It has been 18 months since I filed my 485. So hoping it gets processed soon.

@Shiva - I don't know where they transferred to ( from NBC) yet, as I have not received the notice in the mail. will update here as soon as I do. Wow 18 months is quite long, in fact out of normal processing time (I see online usually 8-12 months for AOS). Are you EB1 (B or C)?

Technically it was concurrent because I filed my 485 while 140 was still pending but at the time I filed my 485, 140 was already pending for 5 months. So it's essentially been 2 years since I started 140 and this process.

@ShivaA - oh ok. If I count the time since I applied my I-140, it is also close to 19 months already.
Hopefully soon it will be done for all of us.
In my case, everything is done and submitted with I485(including medicals), biometrics happened quickly within 1 month after filing. but no progress after that - only this week they transferred to another office. The strange thing is that our I-765 applications were not transferred (they stay at NBC, stuck in fingerprints were taken), only I-485 were.
So, ideally we should just receive out cards quickly, but who knows what USCIS is doing with an ocean of applications for so many months..

True. As I filed by 485 earlier, I at least got my EAD and AP much earlier. That's a good thing which happened.

What is concerning is that the USCIS Case Processing time shows anywhere between 18 months to 42 months as Normal Processing times for Employment Based I-485 Adjust of status depending on the service center.
Of course, we are seeing many people getting the GC in ~8 -12 months, which offers hope. So, hopefully ours is also quick, especially given that our I-140 was already approved. I have not yet received my EAD ( I don't need it as I have valid L1A, but my wife does need it so she can work).

if you have a valid L1A, your wife will get L2S upon re-entry, which allows unrestricted work

@Vin Ken - Your wife can work on L2 EAD. If you are on L1A, unlike H1B, you don't need an approved I140 for your wife to be able to work. Haven't you applied?

apparently, even a reentery is unnecessary:
"If you are an E or L spouse age 21 or over who has an unexpired Form I-94 that USCIS issued before Jan. 30, 2022, we will mail you a notice beginning on or about April 1, 2022. This notice, along with an unexpired Form I-94 reflecting E-1, E-2, E-3, E-3D, E-3R, or L-2 nonimmigrant status, will serve as evidence of employment authorization. If you are an E or L spouse and under 21, or if you have not received your notice by April 30, email E-L-married-U21@uscis.dhs.gov to request a notice."

Thanks Everyone! Really Appreciate all the inputs and suggestions.
She had an EAD (L2 based) which expired in Aug 2022, Renewal pending since May 2022. Also, She had her L2S status on her I-94 which also expired in Aug.. Her L2 Extension based on my L-1A (I539) is also pending since May 2022. So, while a re-entry might get her L2S , it can be seen as abandoning our pending AOS/I-485..We probably should not risk it..
Auto-extension, and this notice via email - All hinges on an unexpired I-94 ( while hers is expired, and her L2 extension is the way to get it but it is taking ages).
So, essentially everything is basically stuck at USCIS who is not moving anything for us.. EAD based on pending AOS seems to happen quicker than L2 these days, so hoping at least that comes in for her quickly.

Just received the Transfer notice in the mail for our case.
"In order to speed up processing, we transferred your case to the following USCIS office for processing"
So, it has been sent from NBC to Texas Service Center (TSC).
I had heard that Texas takes forever (shows 42 months processing time for I-485 EB based for the center), but Let's hope that they approve quickly.

Weird. I thought Texas and Nebraska stopped processing 485s. My case for ex. recently got transferred from Nebraska to NBC. Hope you get your GC soon.

This is strange, I guess they are transferring cases from Texas to other FOs/service centers, I do not know why they would transfer your case to Texas again. Anyways, I hope you get the positive decision you wanted in Texas. Was it your case only that was transferred or including that of your dependents?

Thanks @Shiva A and @JK. yes I find it strange , but at least in the notice I received, the reason mentioned is to speed up processing ( but at one of the slowest centers) .
Our cases are transferred for all of us ( me + my dependents), but for reason, we didn't receive the notice in the mail for my daughter, which is another strange thing.

The phrase "to speed up processing" being consistently used across all transfers so unfortunately it doesn't mean anything. Also don't go with the average processing time. It might be misleading due to lot of outliers which skew the average. Hope you get your GC soon. All the best.

Hey Guys, @JK - Yesterday the EAD was approved for me and my kids ( great news), but not for my wife yet ( strange and she is the one who actually needs it). Has this happened to others where family apps are separated and one member is approved a bit later? Hopefully today / tomorrow for her, but just wondering if this is normal or not. Thanks.. Fingers cross for her EAD and GC next soon for all of us.

@Shiva - our EAD apps stayed back at NBC so they were approved from there. Hope my wife's gets approved in the next day or so..
@JK - what was the delay between others in your family and your 3 year old ? was it days or weeks for EAD approval?
Also, what do you guys think - are we weeks or couple of / several months away from our GCs?

We got ours on Friday while her EAD was approved on Monday. Just a matter of 1 business day. GC approval depends on FO and also differs case by case. let’s all be hoping for the best.

Crazy that even after 3 days, my wife's EAD still not approved. And yesterday my son's AOS/485 case got transferred to another office ( after having been transferred to Texas just 3 weeks ago).. Other's still at Texas ( so far). and we did not receive the transfer notice for my daughter 3 weeks ago..
It is becoming a big mess to follow the trail with different statuses and diff offices for our EAD n AOS apps as a family.. USCIS is doing all they can to make things confusing. oh well.

@ Vin Ken, just relax, I believe the cases are moving. Have you ever inquired about your kids cases through Emma? The live agents are not willing to disclose the status of my kids I-485s to me, even after answering all the requested security questions. They told me my I-485 has been moved to LA, field office, but no clue where that of my kids are.

@JK Hope you are giving your kids name and other details when they are asking you for "your" name, after sharing your kids receipt number. it happened to me once. they didn't share the details but then I had given "my" details instead of my kids details. But from then on I've been sharing my kids details and I get a response every time.

@Shiva, After inquiring about my case, I will ask that I need to inquire about my dependents case, they would ask for receipt number, names, addresses. After providing those details, they will tell me the petitioner/beneficiary should call them. It looks weird to me because I am the primary applicant and petitioner. This had happened to me now on two occasions.

I chatted online (Emma) with an agent, and she gave me the "standard" answers .
*For my wife's EAD (when others' got approved 1 week ago) - she said case processing normally, each case is unique, they process cases in the order they get them (definitively not true), and that I cannot inquire before July 2024.
*For my son's I-485 case 2nd sudden transfer, she had no info other than it is also at Texas (I hope so, not sure why a second transfer).
*For my Daughter, for whom we didn't get a transfer notice in the mail at all, she said it is also at Texas ( I hope) , not notice was sent (doesn't know why)- I will raise an e-request as per the online status after Nov 16.
So, the online chat was not much help really. The waiting continues.

@Vin Ken, I am still surprised why your wife EAD has not been approved. For family case transfer, live agent told me all family members cases are often moved together and treated as a single entity. That could be while you did not get transfer notice for her. I hope you get speedy decision for your cases in Texas.

Thanks @JK. Yeah it is Beyond me as to why my wife's EAD is still not approved. Her AOS was transferred and we have her Transfer notice as well. It was my daughter who didn't received a transfer notice. And now my son's AOS file is again transferred back to NBC ( and his AOS file alone, while ours remain at Texas).. May be it is better for AOS file to be at NBC ..
But on the brighter side, we received the EAD for me, and my 2 kids in the mail today. Hoping that we get our GC approved soon, and this will soon be over .

@Vin Ken - Correct. EB1 will NOT be current from Jan 2023. Not sure what the final action date will be though. USCIS has called this out in their Dec 2022 visa bulletin.
I'm keeping my fingers crossed that I either get my GC before then or at least the dates don't retrogress to 2020 or earlier.

hi @pr g - No Updates on I485, in fact still waiting for my wife's EAD to be approved, more than 1 month after mine and kids' EAD arrived. I am seeing some 485s keep getting approved within 100s range of my Notice numbers, which had their fingerprints taken around the same time as us. But since our cases got transferred ( from NBC to Texas) ours seem to be stuck :-( .. not sure if we can do anything but wait patiently.
We didn't file I-131s coz I still have my L1 Visa valid for next 2 years ( can use it for travel in and out).

Well - no updates on anything. Expedite request was put in for my wife's EAD, nothing since Nov28. Thinking of reaching out to he congressman to help.. And also thinking of filing AP ( 1-131) just in case as my dependents still have their L-2 extension pending for last 7 months.. Depressing and upsetting at the same time.

Thanks community for the support and info sharing.. My Wife's AOS based EAD finally got approved today ( 1.5 months after the rest of the family received ours, and 1 month after raising an expedite request).. It was quite critical for us as she starts her job in Jan ... Now Just waiting for the actual Green card for all of us.. Hopefully soon . With Jan retrogression for EB1, I hope that people still eligible to get their GC will get it quickly, before the date retrogresses further in coming months... All the best to us all. Happy New year Community ! May 2023 bring joy, health, happiness and Green to all of us!
We finally received my Wife's AOS based EAD in hand.
Also, since our Lawyer didn't file I-131 when filing I-485, and because who knows when we will get Greened, I applied for advanced Parole ( I-131) for us --> No fees if I-485 is still pending ( which is good as fees are $575/person otherwise).
Just waiting for I-485 to be approved in next weeks, hopefully.

@Sujatha - No, No Update on I-485 yet. Hopefully soon. As I mentioned above- our case was strangely transferred from NBC to Texas ( as per the transfer notice in the mail) back in Oct, when my I-140 was approved already and when my case was at NBC with PD is current..
Not sure what to expect and when..
Typically, it should be a good news if your case was transferred to NBC if you PD is current.. May we all get Greened quickly.

Thanks @JK and @Shiva A - for the encouragement.. I am getting a little nervous because I see hundreds of cases near my range or even those filed much later than mine getting approved .. while mine is stuck at Texas strangely for last 4 months..
I also may soon have a job offer at another employer (significantly better, in terms of role and salary) and a little scared to do AC21 Job portability with my EB1C ( L1A) case filing I-485J Suppl.. I know H1 ( Eb2 and Eb3) folks do this all the time, but a little unclear about doing so with L1A / EB1C .. hence anxious to get the GC ASAP.. fingers crossed..

Oh Well- A new update for our case today ( only mine and wife's , not kids') , but still the same as the previous status : Case Transferred and new Office Has Jurisdiction.
Doesn't look like to a FO, hopefully back to NBC. Let's see if they send us transfer notices so we know where they transferred this time.
I just don't know what to expect next, and why they are tossing around our cases so much. It is a straight case for approval, PD current, was filed with an already approved I-140. It is a bit crazy that 4 months+ after our cases were transferred from NBC to Texas, they are transferred again.
Hopefully we get the approval in next few weeks. Finger crossed.

Got the Transfer Notice which says "We have completed a preliminary review of your case listed above. As part of standard processing, we transferred your case to..." So now it is at NBC, again. Not sure if this Prelim Review completion is really some good progress ( or fake status) and what to expect next.
Does anyone know what it means to have completed prelim review , or can share a similar experience?

Not real Update TBH.. I asked a Live agent via Emma, and they said that my case was transferred to the LA Field Office (not my local office) around mid March 2023. But no update since then, and I don't fully trust the details from Emma/Live agent.
Not sure if it will be adjudicated there or will be transferred to somewhere else (for the 100th time). The agent also said "the processing time at LA field office is currently 21 months)" .
Super frustrating to see people in EB1,2,3 who filed in Nov or even Dec getting their I-485 approved everyday while ours is stuck in endless cycle of transfers..
Does anyone have any idea - what to expect next? or when?

Hallelujah! God is great! I just got notified on the app that a new Card is being produced (6.30 pm on 05/16/2023). Dependents' still pending but hopefully will be approved in next day or so and we will have our Green Cards in hand in a couple of weeks.
Good luck to all who are waiting, don't give up as there is hope. Thanks to this community- it has been a great source of info and hope.
