@R J Talk to your lawyer for guidance. For EB1A generally J is not required. please consult.

my employer filed my eb1-a petition and I submitted i485J. I’m actually called for an interview at my local office and the list of documents requires i485J. Aug 2018 PD and i485 submitted in July 2023.

for self petitioned EB1A I was told that J is not necessary. I have to consult my lawyer.

i also submitted i485 on eb1a but i didnt. submit i485j as it is not needed. we just included cover letter and highlighted tht part

they are so messy, it may have been a mistake

@Suzy K I agree. For self petitioned EB1A, I always thought J is not needed. I am hearing new things now.

@R J In which FO they are processing your case ? Or it’s in Service center ?

@S SS agree. even I thought J was not required. but since my employer filed, I assumed that’s why the lawyer was submitting J as well. I have no idea. waiting for my interview to understand why they didn’t waive it.

@H S Yes maybe because your employer filed it so the lawyer included the J. So from Non-local FO they sent your case to local FO for interviews?

@R J, I just received RFiE notice today requesting for Supplement J. I am on EB1C employment based. Since its been 15months from the day of my application, they just want to make sure that my employer is same or are there any changes to the employment. in second case you need to send additional form for Job portability.

The other weird part is that this RFE is not updated in my application status online

@Sreekanth Sugnyanamurthy : my sense is that you need supplement J for eb1-c since it’s tied to your employment and not with eb1-a

As per my knowledge if you are on EB1-C and planning to change the employer then you would need to let the immigration team from future employer submit the I-485 Supp J form.

But getting RFE on supp J form is something I am hearing for the first time.

I’m on eb1-a and have not changed my employer (and don’t plan to)

@R J how did you respond to the RFE and was your case approved because I was issued the same RFE for eb1a which is clearly an error from USCIS

@Mel mel : my lawyer responded to the request with the supp J form + a letter stating it’s not required but still if you need it here it is

@Mel mel : case not approved yet. weirdly i was invited to an interview, which happened earlier this week. still no decision yet.

@R J yeah I submitted the supplement j and my rfe response was updated 2 weeks after submission. EAD got approved today but no word on the I-485. Did you ever get your ead approved at any point?

my EAD was approved way back in September last year. i got my i-131 approval on May 19th (2 weeks after the interview but I’m told those are unrelated events.
