rfe for nigerian divorce
I divorced my ex husband in Nigeria . I filed for the divorce in Nigeria and even went to court before the judge who persuaded I resolve issues but I insisted I wanted out and my lawyer gave reasons. he had his lawyer there as well. I got decree Nissi and decree nissi become absolute after 3 months. years later I moved here and got married again, then it was from frying pan to fire,so I filed vawa. now I got rfe that my divorce is supposed to be decree absolute not decree nissi become absolute but that were the documents the court have me in 2016. I don't even know how to locate the lawyer that represented me . I am being careful because I don't just want to send money and someone sends me fake documents as my story was legit my divorce was real. I had a baby with my second husband here but the marriage was too abusive I couldn't bear it anymore. please nigerians here is there another document I was supposed to obtain from the court after the decree nissi become absolute. as at the time of the divorce didnt even intend to use it for immigration as first husband family never accepted me and he was cheating too much. I don tire for real, two marriage wahala, two marriages gone wrong and now have to deal with this whole uscis stuff since 2021.

yes but mine is not fraud, did you read my story? I went to court and got my divorce. I am still married here and we have a child together. my ex is married on nigeria with 3 kids now. the divorce was in 2014,I came here on 2019. I will never do anything fraud ,God forbid it. please can anyone reasonable tell me if there is another document I have to obtain from the court house,I read somewhere it is because I didn't get foreign affairs to verify the document.

@tired from waitingg i don't really know never reay bothered about such things because everything I did was very legit, I am just hearing this for the first time. I am not still shaken because I actually got had a legit divorce not even proxy like I filed with a lawyer ,we went to court for hearing before a judge. this was 5 years before I even came to the states. decided to give love a try again. and it was hell, we had a child together and I wanted to stay for the sake of the child but if I kpai will it be better for the child? I just need to know how to answer the rfe ,maybe there was another document I didn't obtain because the decree Nissi become absolute was after 3 months but the rfe says I should obtain decree absolute but what I was given by the court then was decree nissi become absolute

Hello Uchy. try and contact the court house where had your divorce hearing. they have a record of everything, explain explain your situation to them, let them know you have remarried and you need your divorce clearance certificate and make sure you notorized it. it is very doable if you can get a genius person to do the runnings for you.

@uchy O Yes reach out to Olaleye law firm, I don’t really think you have a problem or say a complex one. If I recall from what I have heard about it, you can get a letter of attestation to translate the finality of your divorce from Nigeria to scale this process. Olaleye spoke concisely about it a few weeks ago. My guess of the question sarrounding Nigerian divorces is the issue of some people being here in the States and file for divorce in Nigeria when they look through the timeline of their stay, the divorce filing couple with when they got their visa to come into the US which doesn’t tally. Though I haven’t used her but I follow her and many others to keep myself abreast with legal issues sarrounding immigration and she is sound in her analysis of this current trend with Nigerian filers which is not just restricted to Vawa alone. I would suggest you stop stressing the factual reality of your marriages as people would still have opinions and biases when they comment on issues.

@jp web I would have kept quiet if I had no solutions or suggestions for her on what she asked than talking about drilling Nigerians, everyone gets drilled this is the UNITED STATES OF AMERICA that hardly even trust their own naturally born citizens, so the issue of highlighting on Nigerians because of fraud BS is just out of context and shameful coming from you who’s filing VAWA as well, I’m sure if your marriage went well you won’t be here trying to file VAWA, and the fact you’re not Nigerian still doesn’t make the USCIS trust you.
@uchy O Do you have Form 35 (Decree Nissi of Dissolution of Marriage) and Form 41 (Certificate of Decree Nissi having become Absolute)? Those are the two certificates you need from whichever court you divorced from in Nigeria. If you got RFE about it just explain in a personal statement “When you got married, how you got marriage, when the marriage started going down the rail, how you managed the marriage, your husband untolerable actions, how you eventually went through the divorce and how you decide to relocate to the US”, they actually not asking for document because most people receives the RFE it’s just for you to explain it cuz presenting another document not relating to what’s submitted earlier is what they wanted to stood a ground that it’s fraudulent, so don’t give them any other documents than personal statement. I know people who receives it and get it treated that way and got approved. I wish you all the best.

@uchy O Be very careful how you respond to them.
I will suggest you go with what @Kenn Kenn. says, write an attestation letter and I strongly recommend you consult with Olaleye as others have mentioned.
When you check the RFE, what was the specifics in it? is the suit no verifiable online?

Thank you all for helping, I have been able to speak with the lawyer that represented me in 2014 in high Court Port Harcourt, she said she will use the suit number to pull up my case again and send all the documents again and will have it verified with Foreign Affairs Abuja and the Embassy. she will also write using her practice letter heading as in an attestation. as I said I went to court for my divorce then ,my divorce was not by proxy. I have spoken to Olaleye today and she said has also advised on a few documents I should put together,she said she is very happy I was in Nigeria when I had my divorce and with her experience took a look at my documents and said they were very valid. also, the lawyer wants to speak with the judge that granted the divorce to attest also . I am so happy that I did this right way and everyone ,OLALEYE, my nigerian lawyer have assured me its okay granting that my divorce was validb

@uchy O, I have a question for you? What kind of marriage did you have with your ex husband? I meant traditional? Church or Court marriage? I am a bit knowledgeable on this subject because I went through the process of frustration before everything went well. So I need your response asap and I will let you know what you need to do

@jp web I wouldn’t have directed this to you but after reading your response I feel obliged as I don’t know if you are schooled or you are just being opinionated about the facts of the fake Vawa filings you claim were perpetuated by Nigerians. I think you have a schewed mind to not know that the so called Vawa fraud was actually perpetuated by a Ghanaian American lawyer and his son who both pled guilty and serving 10 years in prison with million of dollars fined. And yes there are other lawyers involved which are still been investigated but no Nigerian lawyer “FOR NOW”, from my reading of the news have been mentioned. secondly the Vawa claim involved with this Ghanaian Lawyer has to do with parents and children who filed Vawa against their children or parents who they claim maltreated them which is why they are selecting Vawa petitioners for interview so they can ascertain if they are aware that their lawyers filed Vawa on their behalf. Thirdly they found out that lawyers who filed marriage based cases on behalf of their client and switching it to Vawa and that is unethical to do as the lawyer who files a marriage based case for clients is suppose to be representing the US citizen and not the beneficiary. This is what triggered the scrutiny and not the Nigerian BS you are spewing. I suggest when you read information on issues, try to read to understand and not just jump into conclusion.

@lala lala ,we only had court marriage in the same court that I had the divorce. we were supposed to have trad and white but everything went south so I got a lawyer and asked for a divorce.

@uchy O You will have to go to the department of state website and see the reciprocity documents with Nigeria.
if your Decree nisi is acceptable document for divorce then you Mr lawyer can use that as a reference to respond to USCIS.
what ever the department of states says on their website is the standard for whatever document you have to submit, that is the rules the USCIS follows.

but with my husband here we had trad here but he sent his people to my village, then we had court and church that is my present husband that I have a child with. but with my ex husband it was court only. USCIS is just requesting that I provide the absolute ,what the court gave me is nissi become absolute. using my suit number olaleye said the court will be able to retrieve my file and help but anymore input will help me,how were you able to resolve yours

@uchy O my advice is get an attestation/affidavit from court attesting to the dissolution of marriage, This is what I was advised incase I get an RFE, I divorced my Nigerian husband too

just wanted to thank you all again, the documents have been verified from ministry of foreign affairs as authentic and I have gotten thr CTC. also I got my 5 year EAD a week after RFE was sent, it will end in praise . happy new year everyone
