Timeline and a thought

I’ve been reflecting on something lately and wanted to share my thoughts. I’m starting to consider applying for Premium Processing (PP), but I keep asking myself—why? • I’m not current, and realistically, I probably won’t be anytime soon (2026-2027).
Still, I’m beginning to think it might be a good idea to have my case processed sooner, especially BEFORE any changes or new regulations are introduced by the incoming administration.
I understand that systemic changes take time, but let’s not forget that these agencies often operate in their own world. Historically, they’ve made decisions based on discretion and the priorities of their officers, so there’s always some unpredictability involved.
On the flip side, some lawyer friends have advised against this approach, pointing out potential downsides. For instance, they suggest it could lead to a
• Request for Evidence (RFE), possibly as a way to buy more time since the system is overwhelmed.
• Worse yet, an RFE could escalate the case to higher-level officers, who are known for stricter reviews and higher denial rates.
Despite these concerns, I find myself leaning more and more toward applying for PP. I’ve even started saving up to make it possible. It might not be a perfect plan, but it feels like the right step for me right now.

I’ll suggest you go ahead with the PP. Better to get an early decision (whether RFE or approval) and file for AOS when current, than to be current and be battling RFE wait time (if any). Not to mention the uncertainties that lie with the new administration. However, considering that the new administration would kick start in a week time, filing PP now may have zero benefits if your initial plan was to have your case adjudicated before the new administration.
Best wishes.

@Lex K thank you for your input, However, the Administration does not adhere to the executive election. The timing varies, and transitions usually take four months to a year before new officials receive their assignments and instructions. Therefore, timely decisions are essential.
Thank you.

its not worth it as we have waited for so long. now even with PP cases at NSC can take 50 days.

it's definitely a your decision. but if I were you I would wait. pp is 45 business days and we know Nebraska is going to refund some pp due to a huge pp backlog. regarding the regular applications, Nebraska is processing 09229 block, early November, which means that your PD should be processed in at most a couple of month, I would say the end March at most. that's my 2 cents, I'm >400 days like you and I have the same concerns

@Anto A Right,
I was calculating the same… the timeframe to wait, for a couple of months more.
My block has stopped moving for about six months now. I think I'll wait until February 1st to proceed. After that, I plan to do a PP hopefully, 🤞🏻 as I don't want to take any risks.
Thank you for your thoughts.

@Duc Hoang True! I think is not worth it if I take into account only the AOS, but I’m worried with this new administration…
Lets see…

The believe the new administration will favor legal immigrants. They are clamping down on illegal immigrants. And looking at it, USCIS is unable to focus on applications submitted the appropriate way because they are trying to declutter the issue with illegal immigrants so it doesn't become a problem by issuing them necessary documents to enable them work. They also have asylum seekers to deal with. As long as you are in the US legally and maintain status you have no problem.
I was issued an rfe asking for proof to show I maintained status before submitting AOS..... so maintaining status is very important.
My suggestion: If u will still be in status by 2026-2027 you mentioned, save your money for AOS, it's not worth spending such amount on pp.

And if not, apply for school to keep you in status

If you receive a denial, you'll lose your PD. I've learned that taking action on anything related to USCIS is the best thing you can do.

@B OO thank you I’m enrolled until 2026…

@Ahmed Ibrahim
I’m sorry I don’t understand what’s your point?
I mean, of course everyone knows a denial on a process leads to a refilling, and a New PD.
J HJan 11, 2025
I saw some decrease in approval case in the stats of this app. do you still plan to go for PP this or next month?
Y TJan 12, 2025
The pain of waiting for a decision can be very excruciating. I can’t describe how relieved I was when my petition was approved this time. The journey started in August 2023 with premium processing and got denied in February 2024 after responding to RFE. I was devastated but didn’t give up. I filed another petition in July 2024 also with premium processing and got Approved in January 2025 after responding to RFE. My mental health was messed up since 2023 because of this journey. I wish everyone still waiting a successful outcome
Kar NIW i140-Nov 2023’Jan 12, 2025
@Jahid Hasan yes I am,
I’ll do my best to get the resources for it ASAP, I’ll try to wait until 430-440 days, if I don’t get an answer I’ll proceed.
Kar NIW i140-Nov 2023’Jan 12, 2025
@Y T
Dis you changed your petition a lot? or you think was a matter of a “Bad” officer taking your case?
and I’m glad you where approved!
to be honest right now my only concern is money, so as soon as I can get it, I’ll proceed.
