For those asking why we are concerned about this and considering a priority processing (PP) even when we are not current, it's important to clarify our perspective. Our primary concern is the possibility of receiving a Request for Evidence (RFE) or another issue, and we want to secure a priority date (PD) as quickly as possible. This way, we can take action and address any problems that may arise.
•So NO! it has nothing to do with being “CURRENT”.

• the rest, is my personal thoughts… as I see a lot of people questioning about “why getting PP” if we ain’t current.

the need to have a peace of mind is definitely understandable. if you have the budget, then go for pp. But be prepared that unfortunately the anxiety and uncertainty do not go away. there will still be waiting to be current and then waiting who knows how long for i485 to be approved. the torture doesn’t end. Best to not obsess over it. my first paperwork for green card was filed in march 2022 - almost 3 years ago and I’m still waiting.

Honestly, “peace of mind” at this point isn’t the real reason for the priority processing (PP); the actual purpose is to plan as soon as possible for a Request for Evidence (RFE) or any other issues that may arise, while also preserving a priority date.
At this point everyone knows, that it will take years an AOS.
I hope this makes my point clearer.

i agree with @Kar NIW i140-Nov 2023’ . if you can afford , better do PP. current or not current atleast ull know i-140 is approved or not. i did PP and got approval in 5 days . then i waited for more than a year for my application to become current. filed i485 in december

let’s be honest given the rate of RFE lately, I think the way you write your petition matters and if the officers feels your write up is something that can take time to read and adjudicate they may suspend it and attend to people with more detailed petition before eventually coming back to yours , people should understand that just because you have the required certificate or degree doesn’t necessarily mean you qualify for NIW especially if your don’t prove your case beyond reasonable doubt.. and again country of origin is also a factor.
I feel these officers attend to cases based on how well written your cover letter is.. your response will come as long as they’ve sent you a receipt notice…

mind you a lot of cases that was filed after yours have received either approvals or RFE which further validates my first comment.

@f c My case is currently positioned exactly in the middle of 15 cases that are "Actually Being Reviewed" between October, November and December 2023, based on “case number”. Additionally, my case is among 502 I-140 petitions “By Date” that have not advanced in the review process for about six months, as you can easily verify using web crawlers sites.
Of course this is stats, and no one really knows the order or how they adjudicate the Cases.
So far, none of the cases near mine have been adjudicated under normal processing. While I have seen some cases that were updated to Premium Processing (PP) and end up recently adjudicated, there has been no movement in my group under normal processing. I monitor this situation weekly, and I believe my lawyer submitted a strong cover letter (At least I hope so, as being one of the top lawyers for STEM EB2-NIW). However, at this time, I cannot afford Premium Processing.
Now I’m just crossing my fingers and hoping for the best…

the priority dates are most likely to become current in the next 2 months , between April and may based on February visa bulletin

did you end up filling PP? My PD is close to yours (29 Nov 2023) but would rather wait. I think in the next two months there will be an update as USCIS seems to have started reviewing Nov-23 cases (based on casestatusext.com).
