Hi guys,
So I have this question.
On advance parole can I fly from US to Canada and then go from Canada to France, then back to the USA or can I do:
1. USA - Canada - USA and then USA - France - USA
or
2. USA - Canada - France - USA

@Aj RAF The best time to use it is as long as itās valid āŗļø

you can exit us and re-enter US, but donāt die so you re/ enter š
Tom Hankās HansOct 25, 2024
@Aj RAF I have something to tell you serious. Your AP can be valid for another 4 years but since your VAWA is almost on the verge of getting decided and if you already had divorced from your U.S. citizen abuser and again knock on the wood if your VAWA gets denied while you are out of US on a visit and when you return back then they will never let you enter US. So wait for the decision before you fly or if you are sure your VAWA case is sure approval then fly

@Tom Hankās Hans @Miss M @Aj RAF
Your Advance Parole is not dependent on the status of your VAWA case but rather on the status of your I-485 application. As long as your I-485 is under review, you are free to use your work permit and travel authorization. However, if your I-485 is denied or canceled, all privileges associated with that application (such as the work permit and travel authorization) will automatically be revoked. Even if you are outside the United States, immigration will still send a Notice of Intent to Deny (NOID) a few weeks before canceling your I-485.

Even if, in an extraordinary situation, your I-485 were canceled while you were outside the U.S., once you arrive at the airport, they would still allow you to enter but would initiate removal proceedings against you

@max 221 Thank you!
Missy MayOct 25, 2024
@max 221 So before they deny your application they will send the NOID?
How about if they deny your vawa and that your I485 is dependent of your vawa, will you be allowed back in the country or not?
Tom Hankās HansOct 25, 2024
@max 221 One of VAWA case whom I knew personally exit to Her country for a month. During that time, her VAWA got denied following the I-485 and all her EAD and advance parole. She was able to board the flight to US but at the port she was told that she is out of status and cannot be let in unless she is still married to the U.S. citizen or she has a U.S born child. Luckily she was still married at that time and they verified her marriage status before they let her in. Thank you. I would suggest Miss M to check with her lawyer before she can decide anything. Here we are just sharing our experience.

@Tom Hankās Hans I divorced my abuser and I have two US citizens kids for my ex. they would be traveling with me as well because I have to pay my last respect to my mother whom I lost this month October

Good afternoon,
First and foremost, I am very sorry for the loss of your mother.
Your current work permit also serves as your advance parole card (in the bottom left corner you will see it says āSERVES AS I-512 ADVANCE PAROLEā).
Both your work permit and advance parole are valid until 2028, so you can travel as much as you want until then. There is not a limit of the time you can be outside the country, but in general I recommend no more than 45 days at a time. So, with the plans you have in ā¦.. for 2 weeks, you should be fine.
Best,
hereās the message my lawyer sent to me.
