I would suggest you call them and tell them you got a notification of a missed interview but never got a letter for the interview and then inform them that you have a petition you filed since 2021. call them before they close today and if you can’t reach them make sure you get them first thing in the morning. Because if you don’t and you have an EAD based on your I-130 they would automatically cancel it and that would put you out of status.

@bridges 5 Thank you. I will do that , the last time I got a notification that my interview was scheduled was last month, my lawyer said I should ignore it and that it won’t affect me, but I will call them, do you think someone will speak with me since I am already a Vawa recipient?

Once you are connected they would speak with you. To be honest it won’t affect your new filed Vawa petition but it may lead to the cancellation of your C09 employment authorization document if you have one based on your i-130 because that interview is actually for your I-485 (adjustment of status) linked to your I-130.However if you reach out to them or if you had gone for the scheduled interview and explain that you have filed the I-360 and you would want them to put your I-485 in abeyance pending the adjudication of your I-360 they would give you options. Someone will speak with you and you are not a Vawa recipient yet but a Vawa petitioner for now. when they approve your Vawa, you become a recipient. Your lawyer didn’t advice you properly. You should have gone for it which is always a better option than not going because for not going it is assumed you have abandoned your filed I-130 which is the basis for your adjustment of status and once that is denied due to you not attending they send you a NOID and then cancel your application which invariably would cancel your C09 EAD as you have it based on your I-130. I would advice you to file another I-485 and I-765 (C31) EAD based on your Vawa now if you haven’t done so.

@bridges 5 okay, so I already went for my I485 interview linked to my I130, we went in 2021, funny thing was that my abuser went with me, but because he already moved out and abandoned our daughter and I,the interviewing officer suggested I file for Vawa and put the I485 in abeyance. He believed I was a good candidate for vawa, I do have my EAD co9,recently I went to renew my drivers license, and it was valid for 8years, so I would never have thought I will get further updates on my I130 .however I will call the now, thanks for your input
